Noland Law Firm attorney Ali Noland is a strong advocate for public education in Arkansas and serves as an elected school-board member in Little Rock.

Now she’s leading the legal battle against the Arkansas LEARNS Act with a lawsuit that she recently filed against the Arkansas Department of Education, the State Board of Education, and the Secretary of Education, Jacob Oliva, on behalf of a group of Marvell-Elaine School District parents, grandparents, employees, and residents who oppose a planned charter-school takeover of their district and on behalf of the group Citizens for Arkansas Public Education and Students, which is working to repeal the Arkansas LEARNS Act through a citizen-led referendum petition.

The lawsuit seeks declaratory and injunctive relief preventing the State from prematurely and illegally applying the LEARNS Act before it becomes law.

This isn’t the first time that Noland Law Firm attorneys have helped public-school parents exercise their legal rights by challenging the unconstitutional actions of the Arkansas State Board of Education. In 2020, attorney Ross Noland represented a group of LRSD parents in a suit to end the prolonged state takeover of the district.

Ross argued this morning before the Arkansas Supreme Court against the State asserting sovereign immunity when an agency exceeds its statutory authority--specifically in favor of plaintiffs' case below seeking to lift State imposed "guardrails" and unilaterally created exit criteria from the LRSD and its recently elected board.

From a history standpoint, this was likely the last pandemic-era virtual argument before the Arkansas Supreme Court, as it is the last oral argument of this term, before the Court hopes to return in person this fall.

This morning Noland Law Firm and Poynter Tucker, An Association of Law Firms filed suit against the Arkansas Department of Education, Commissioner Key, and the State Board of Education Members. The suit seeks to have the Court declare that both the State Board's guardrails on the future LRSD School Board (prohibitions on litigation, recognizing the teacher's union, or hiring/firing a superintendent) and criteria for exiting state control are illegal. The State Board had five years, pursuant to state law, to control LRSD. That time is up, the guardrails and exit criteria cannot apply to the new board. Five years means five years.

Noland Law Firm appeared on behalf of Audubon Arkansas yesterday before the Arkansas Public Service Commission to advocate for regulations consistent with the purpose and intent of 2019 Ark. Acts 464--to expand and encourage rooftop solar in Arkansas. The law removed restrictions on leasing agreements for installations and raised size limitations. Now, we look forward to Commission rules furthering those intents.

The Arkansas Public Service Commission was urged Thursday to take quick action to resolve rate issues related to solar usage and deployment across the state.

Last week the Arkansas Public Service Commission issued an important ruling in Docket 19-055-U directing utilities to immediately honor the law as it pertains to 2019 Ark. Acts. 464, a law which lifted artificial limits on solar project size and financing.
