The order signed Wednesday seeks to protect the country from the virus and jobs for Americans in an unstable economy. But what does it really do?

A question we are often asked is if immigrants are eligible for unemployment benefits? The answer is, of course, it depends. Generally, it depends on if the immigrant is authorized to work and is available to work for an employer. People on H1B visas, for example, are not "available" to work for another employer, as their visas are tied to a specific employer. People who are undocumented are also not eligible for unemployment benefits because they are not authorized to work. However, DACA recipients and lawful permanent residents (green card holders) are authorized to work and are available to work for any employer. Therefore, if you are authorized to be employed AND you are authorized to work for any employer, then contact your state to determine if you also meet their specific criteria for benefits.

This is especially dangerous given the increased risk of applicants being placed in removal/deportation proceedings under the Trump administration.

The lines might be shorter, but it’s getting tougher to obtain a green card, according to USCIS immigration data for fiscal year 2019.

Would this new restriction impact pregnant women with genuine medical needs? It will come down to how individual counselors enforce it.
