Here is just another example of the work we do helping clients get justice. In this case, a jury awarded over $150,000 to a young girl who was attacked by an alligator at Moss Park. The jury verdict, however, was snatched away by a Judge who concluded that Orange County owed no duty to warn its guests that the swimming area it created for its guests had alligators in it. With a straight face, Orange County argued, and the Judge agreed that Orange County had no duty to warn to warn its guests about alligators in the designated swimming area even though Orange County created this dangerous swimming area, cloaked it with the appearance of safety - a sand beach, buoys, ropes, and a lifeguard - all with the unrefuted knowledge that alligators had been spotted in this very swimming area. We are fighting hard to get this little girl's verdict back.

Here is a snippet of some of what I do at work. Part of what I do is handle appeals. Part of that process is oral argument where I have to convince a panel of judges that another judge was either right or wrong (depending on what side of the case I am). In this appeal, I had to convince the panel of judges in the Third District Court of Appeal that the trial judge made the correct ruling. This is tedious work and typically involves reviewing thousands of pages of documents, drafting lengthy briefs, and presenting oral arguments. I win appeals and a I lose appeals, it comes with the territory of being an appellate attorney. Appellate attorneys are in the business of either cleaning up messes or holding judges accountable for following the law. There is obviously great joy when I win and appeal, but when I win an appeal because the Defendant's attorney agrees that the trial court was wrong based on a brief I draft, it's even sweeter.

*BTW, I never do this, but in this case, I emailed the Defendant's appellate attorney (appellate attorneys are way more rational than trial attorneys) before I filed my brief and asked him to confess error because the judge got it so wrong but he refused. He confessed error once he got my brief.

Occasionally I like to let you know what kind of appeals I am working on so you can have a glimpse into my world. And for some, it may just help you on cases you are working on or will work on.

In this case, the court refused to allow an extension of time for the plaintiff's attorney to conduct additional discovery when (1) she was on maternity leave for part of the case, (2) the defendant disclosed its expert late and disclosed its expert after the discovery deadline, (3) the defendant produced its expert's affidavit for the first time just 13 days before the summary judgment hearing, (4) the plaintiff's attorney found out about additional relevant documents that had previously been requested by the plaintiff but that had not been produced by the defendant, and (5) there had been no prior extensions requested. All that aside, this was also a battle of the experts, but the trial court concluded that the plaintiff's expert was simply not good enough.

We filed this initial brief and if you are so inclined, please read and give me your feedback. Hoping the Second DCA gets it, and gives our client a shot at a trial on the merits.

We understand that applying for your VA benefits can be time consuming, confusing, and complicated. Fortunately, there are plenty of people and groups who are willing and able to assist you through the process, but beware.

Scammers are everywhere.

You shouldn't have to pay someone to help you apply for the benefits you've earned. The VA itself has a helpline and chat system that can walk you through the process. There are also videos, and walkthroughs that can assist you with how to fill out the specific forms and what files you'll need to attach in order to get the proper rating for your service.

If you're unable to find exactly what you're looking for and need additional assistance in applying for the benefits you earned through your service, you can contact us. We've helped many veterans through the process of applying for their benefits, and we'd be happy to assist you as well.

If you've already applied and have been denied or received a low rating, then reach out to us. We can appeal the decision and ensure you get the benefits and the rating you deserve.

Introducing our October Veteran of the Month, Staff Sergeant Andre Rivera.

He is a board member of Semper Fi Service Dogs a 501(c)3 dedicated to saving local dogs, training them to be professional service animals, then utilizing them to save veteran lives. He is a Junior Vice Commandant of the Marine Corps League Detachment 1058, which supports local veterans and the community. He is a Life member of the Veterans of Foreign Wars, American Legion and Spartan Sword.

SSgt. Andre Rivera is the founder of the Veterans Resource Network (VETRENET), a veteran business directory, and all-encompassing veteran resource for all things beneficial to a veteran. VETRENET promotes veteran businesses.
