KANE SAO PLANS FOURTH OF JULY ANTI-DUI INITIATIVE

St. Charles, Ill. - Kane County State’s Attorney Jamie L. Mosser announces that the State’s Attorney’s Office will work with Kane County police agencies on an anti-DUI initiative over the Fourth of July holiday. The initiative, called a No-Refusal operation, will start at 10 p.m. on Friday, July 4 and end at 2 a.m. on Saturday, July 5.

No-Refusal operations are designed to assist police efforts to obtain a search warrant for individuals who refuse to submit to chemical testing after a DUI arrest. Kane County Assistant State’s Attorneys are on hand to assist police officers through the search warrant process to compel a DUI suspect to submit to a lawfully requested blood, breath or urine test as required by Illinois law.

Illinois courts have held that a person has no right to refuse chemical testing when probable cause exists. Anyone who declines to submit to chemical testing after being presented with a search warrant should expect to face additional charges.

The operation will be the 40th No-Refusal since the Kane County State’s Attorney’s Office began the program in 2008.

SA Mosser said: “When a person decides to drink to excess and get behind the wheel of a car, they place everyone in danger. Independence Day falls on a Friday this year, which means more people are likely to celebrate excessively and take unnecessary risks. Since we all have a responsibility to protect ourselves and others, plan a head for alternatives like designated drivers, taxis, Uber and Lyft. Anyone who chooses to compromise public safety will be prosecuted to the fullest extent of the law. Thank you to all of the law enforcement who will be patrolling that night.” # # #
