U.S. Citizenship and Immigration Services (USCIS) confirmed that they received enough initial electronic registrations to meet the FY 2027 H-1B numerical allocations, including the advanced degree exemption (master's cap). Petitions for selected beneficiaries can be filed within a 90 day window from selection.

Today, we are celebrating Brown Immigration Law's 20th anniversary! 🎉

To mark this milestone, we’re paying it forward. Since our founding, we’ve been focused on growth – individually, professionally, for our clients and their talented people. We’ve also been focused on supporting the growth of companies that help solve difficult problems, especially in areas surrounding our environment.

In honor of 20 years, we’re taking growth to a new level. We are partnering with the Arbor Day Foundation to donate $20,000 to plant trees, including more than 2,000 trees in Northern California (an area special to us and many of our clients). These trees will support reforestation efforts in areas decimated by wildfires, and improve the health of the surrounding land, water, and air. We look forward to the real-world impact this project creates as the benefits of these new trees literally, grow! 🌱

🚨 Update: Government Shutdown 🚨

As of today, October 1, 2025, the federal government has shutdown due to Congress’ inability to pass a budget due to gridlock. Immigration agencies are each impacted in different ways, with some services continuing while others may slow down or pause until funding is restored.

Yesterday, on September 19, 2025, President Donald Trump signed a Proclamation titled: “Restriction on Entry of Certain Nonimmigrant Workers”, available here: https://www.whitehouse.gov/presidential-actions/2025/09/restriction-on-entry-of-certain-nonimmigrant-workers/

The proclamation restricts the entry of H-1B nonimmigrants into the U.S., requiring U.S. employers to pay a $100,000.00 fee for each H-1B worker seeking entry to the U.S. after its effective date. Given the sudden imposition of the fee and its sudden deadline, many individuals on H-1B are making plans to return to the U.S. prior to its implementation.

For any individual who chooses to return, you must clear immigration screening prior to 12:01 am EDT on Sunday September 21, 2025 to avoid its implementation (less than 15 hours from the writing of this note).

We have now published guidance and recommendations on our website for various situations, including those with immediate travel concerns.

🚨 Important update from the U.S. Department of State: As of September 6, 2025, applicants for U.S. nonimmigrant visas must now schedule their visa interviews in their country of nationality or residence.

For years, U.S. consulates around the world have generally allowed third-country national (TCN) visa appointments, where applicants could apply outside their home country. While consulates have always had the authority to limit these, this update signals a broader stop to TCN visa processing.

The Department of State confirmed that existing visa appointments will generally not be cancelled, but if you have an interview scheduled in a third-country, be sure to check for any updates or messages from the consulate.
