Our co-counsel, David Garrison, will argue at the Kentucky Supreme Court at 11:00 am today on behalf of our clients in Held, et al. v. Hitachi Automotive Systems, Inc. The key issue is how Kentucky will apply its Wages & Hours Act in light of the U.S. Supreme Court's recent decision in Helix Energy v. Hewitt. The Court will decide whether the trial court prematurely dismissed the unpaid overtime claims of our class of supervisors at a Madison Co. manufacturing plant. 19 years ago today was a somber day, one of the most shocking single tragedies ever to hit our community. The passengers on flight 5191 were our neighbors, our colleagues, our friends, and our guests. Today we remember our clients and all the other passengers whose lives were lost far too soon. One of the great traditions at the University of Kentucky College of Law is the Garmer Cup closing argument competition, held annually by the Trial Advocacy Board in memory of Bill Garmer. Here is Jay Prather awarding the Cup to this year's overall winner, third-year student Jacob Patterson, as the runner-up, Daniel Short, looks on. Once again, our attorneys are happy to stand up for the rights of restaurant workers who are not paid what they are owed.

If you worked as a server at Carson’s on Main or Carson’s at Andover during the past three years, this lawsuit might affect you. It alleges that Carson’s violated state and federal law by requiring servers to share tips with employees who were not eligible to receive tips (like barbacks and bussers) and by requiring tipped employees to perform significant amounts of non-tipped work (such as opening and closing “side work”), among other things.
