Things of the Law # 2

The Federal Rules of Civil Procedure, and most state Rules begin with the the premise- Rule 1- that the rules are “ to be construed to secure the just, speedy and inexpensive determination of every action.”

I can say without equivocation that this is nobly stated, but in practice it is hardly ever true. Modern Day civil litigation is seldom speedy, and it is an uphill climb to get justice. You have to fight to get it. And it is expensive. Good lawyers know this. To get through the legal process and get to a courtroom is akin to an obstacle course! I have recently likened getting a case tried or settled to a football game. You are trying to move your ball down the field and across the goal line and the opposing side is trying to stop you on every play.

Hire a lawyer who knows how to move the ball.

The Art of Cross Examination

If you are examining a witness for the defense or any witness really, STAY WITH THE WITNESS! This applies particularly to defense experts, who like to explain, dodge, and evade answering any question which hurts the defense.

If they don’t answer the question directly when you know the answer, as you always should, simply thank them, and say, I need an answer to the question I asked you. And ask it again, as long as it takes to get the answer!

So I am in Georgia. Here to see a client who was the victim of yet another tractor-trailer crash. Looks like I will be able to help her. But will have to file suit. It fits into the nothing is easy bucket!

But the drive over this evening was exquisite! Traffic was light. And I listened to oldies all the way over.
