Consumer alert! Bank of America is attempting to require arbitration for issues with Bank of America. If you use Bank of America for any reason, in order to preserve your right to have issues resolved as usual (with a typical right to go to court) instead of with a private arbitrator in arbitration, here are the instructions to quickly opt out of Bank of America’s attempt to force any issues to be sent to a private arbitrator in arbitration.

Of note, in court, the court system is publicly funded with a right to a jury trial, but if sent to arbitration a private arbitrator decides the case & often costs and has to be paid hundreds of dollars an hour to work on cases, which could be cost prohibitive depending on what the issue is. Also, the bank may then argue that you would not have regular rights of appeal or the many protections generally afforded to regular cases as otherwise guaranteed under the law and constitution.

We often see these “forced arbitration agreements” in our nursing home cases as well, and a jury trial with no signing of an arbitration agreement is generally preferable to vindicate one’s rights as our founders envisioned with a day in court instead of with a private arbitrator.

The Supreme Court recently heard oral arguments in the courtroom of the University of Kentucky’s new law school in one of our cases. The actual Supreme Court of Kentucky courtroom at the state capitol is currently under renovation and the Court has been traveling around the state recently to hold its oral arguments. In our case, we prevailed on behalf of our injured client in the lower court and the case is now on review by Kentucky’s highest Court, the Supreme Court. At oral arguments we were also provided with an informative flier regarding the makeup of the Kentucky court system, the Supreme Court, and the cases slated for oral argument.

This is the third of our firm’s injury cases in four years reviewed by the Supreme Court, and we now await a decision, which is expected in 2026. This week, the Supreme Court also ruled that it would hold another case with similar legal issues in abeyance pending the final decision in our case. The Kentucky court system handles about 800,000 court cases per year at various levels, and the Supreme Court currently grants and hears about 50 oral arguments per year in cases which it finds present “special reasons” for its review, which is less than .0001% of overall cases per year.

All finished final prepping for oral arguments tomorrow before the Supreme Court in one of our cases! The Supreme Court is traveling for oral arguments this month and will be holding oral arguments at UK’s law school starting with our case as the first argument.

A recent To-Be-Published KY Court of Appeals opinion has unanimously ruled in favor of V&V’s client in a case brought against a nursing home chain alleged to have neglected its resident—pictured is V&V presenting its oral argument before COA judges (the official video is not great resolution).

The KY COA is KY’s intermediate appellate court where most appeals in KY state court cases are decided. In this case the lower trial court had ruled in favor of V&V’s client, the nursing home chain then appealed, and on appeal the COA affirmed the ruling of the lower court. At the COA, the parties filed written briefs, after which the COA then scheduled the case for oral arguments before COA judges, after which the COA issued its written opinion which affirmed & designated the opinion as “published” so that it will be reported in the official KY case reporter and can be cited as providing published & binding precedent for other cases across KY (most cases at the COA are neither orally argued nor officially published).

V&V has recently handled numerous successful appeals for clients in injury cases, including appeals resulting in published opinions.

V&V attorney Todd Varellas has been reelected to continue to serve as a board member of the Kentucky Justice Association, the state’s trial lawyers association. The Association’s more than 1,400 members are committed to improving the quality of legal representation for KY families and seek to protect the 7th Amendment right to a trial by jury so any person can seek justice when necessary in the courtroom.

We’re going back to the Supreme Court! Kentucky’s high court has again granted discretionary review in one of our cases, with oral arguments at the capitol to be set in the coming months. The Supreme Court grants discretionary review in a small number of cases—about 50 to 60 per year for the state, of which an even smaller portion are injury cases such as this—in which it deems there to be “special reasons” for review in order to establish and further refine the law of Kentucky.

This will be V&V’s 3rd time in 3 years appearing before Kentucky’s highest court for oral argument. Also pictured is our last appearance before the Supreme Court last year in which we prevailed in another case which set precedent that has assisted many injured persons with their meritorious cases.
