Being someone's child, emergency contact, or closest relative does not automatically give you unrestricted authority to manage that person's financial affairs while they're living.

That's one reason a properly prepared Power of Attorney can be such an important part of an estate plan.

It allows you to decide ahead of time who you trust to act on your behalf and what authority that person will have.

The important part?
You get to make that decision while you're able to make it.

When was the last time you reviewed your estate plan? If your answer is “it has been a while,” you are not alone. Many people assume their estate plan is complete once it is signed, but in reality, it should be revisited over time to ensure it continues to reflect your wishes.

Here are a few key things to keep in mind:

🔹Regular Reviews Matter - It is often recommended that you review your estate plan every three to five years to keep it aligned with your current circumstances.

🔹Life Change Updates - Events like marriage, divorce, or welcoming a child should prompt a timely review, ideally within 60 to 90 days after the event.

🔹Know the Common Triggers - The “5 Ds” (death, disability, divorce, distance, and descendants) are considered the most common triggers for a review.

You may have heard someone say:

"I want to give my house to my children, but I want to live there for the rest of my life."

That's where the concept of a life estate may come up.

A life estate is an ownership arrangement that can give someone the right to use or live in property during their lifetime, while another person has an interest that generally takes effect afterward.

Sounds simple enough — but property transfers can have important estate planning, Medicaid, creditor, and tax considerations.

So before changing the deed to the family home, it's worth asking an elder law attorney how that decision fits into the bigger picture.

Creating a trust is one step.
Funding it is another.

Funding a trust generally means properly transferring or connecting appropriate assets to the trust so it can operate as intended.

Depending on the plan, that might involve real estate, certain financial accounts, or other property.

A beautifully drafted trust that was never properly funded may not accomplish everything its owner expected it to.

Think of it like buying a safe but forgetting to put anything inside. 😅
