Ethan Allen returned to England after the war, and the British made fun of him. One day they put a picture of George Washington in an outhouse where Allen would be sure to see it. He used the outhouse but said nothing about the picture. Then the British asked him about it and Allen said it was a very appropriate place for an Englishman to hang the picture because “nothing will make an Englishman s**t so quick as the sight of General Washington.”

After the SCOTUS decision in VIKING RIVER CRUISES, INC. v. MORIANA, it looks like California will need to amend their Private Attorney General Act (PAGA), otherwise PAGA is going to lose a lot of its utility. The ability of employees to have their collective rights vindicated will take a hit unless California acts on this quickly.

New York will need to review the Empowering People in Rights Enforcement Worker Protection (EMPIRE) bill to ensure compliance with the concerns raised in VIKING RIVER CRUISES.

The plot thickens... slightly.

The 2nd Circuit has issued a temporary injunction against the portion of the mandate that requires all New York City Department of Education workers to submit proof of the first dose of COVID-19 vaccination by September 27, 2021, pending review of this motion by a three-judge panel. See Maniscalco v. New York City Department of Education.

This is not particularly ground breaking news for those against the mandate, as at least one temporary restraining order against the New York mandate has already been lifted. So far, these are best categorized as plaintiff-side procedural victories.
