Justice served in Warren County, Virginia. 🐾⚖️

Animal Services unlawfully removed two puppies from our client based on neglect allegations that simply were not supported by the evidence. Our firm fought to ensure the truth was revealed.

Attorney Shaniqua Clark Nelson successfully defended the case, demonstrating that there are a variety of reasons for a pet to be underweight without neglect in the home. As a result, the court ordered the puppies returned to their rightful owner and declined to impose any boarding costs.

This outcome reinforces an important principle: agencies must follow the law and respect the rights of pet owners. When those rights are challenged, we stand ready to defend them.

No family should be torn apart by the Department of Family Services without real cause.

Virginia law is clear: removing a child from their home is an extraordinary measure. Under Virginia Code §§ 16.1-251 and 63.2-1517, the state may only remove a child when there is imminent danger to the child’s life or health and that a less drastic alternative does not exist that can keep the child safe.

Yet too often, families are devastated by deficient investigations and unnecessary government interference. The trauma of separation leaves lasting scars, not just on parents, but on children who deserve stability, love, and safety within their own homes whenever possible.

Parents have a constitutional right to raise their children without unwarranted intrusion. When the system overreaches, families need experienced advocates who understand the law and are willing to fight for what is right.
