I am a little bit late in reporting this, but ML shareholder Sameera Ali has been churning out the big wins faster than we can keep up with them. Last week, she not only successfully got ill-gotten evidence suppressed, she got the judge to issue a written opinion ruling in her favor - a written opinion that will become precedent and law in the Commonwealth.
Fore those unfamiliar with criminal procedure, motions to suppress evidence collected by the police are routinely dismissed out of hand without explanation by the Court. But the law should never be a matter of "rubber stamping" whatever is convenient. By making the court take a closer look and issue a written opinion on a crucial legal issue, Sameera is helping ensure that the law applies to everyone, and that legal process is fair and reliable.
Some may argue that defense attorneys exist to help get bad people "off on a technicality," but that sentiment always makes me bristle. The U.S. Constitution is not a "technicality." It is the law of the land and the criminal defense attorney is the often the only one guarding that principal.
