My practice emphasizes the representation of clients who have been injured due to the negligence of others as a result of car or motorcycle accidents. A client who owned a roofing business was denied coverage by his own insurance company because of an exclusion for "heat applied roofs" after he was sued for $800,000.00. While my client's insurer never admitted that it wrongfully denied insurance coverage, it paid $350,000.00 towards the settlement AND paid my very reasonable attorney fees in defending my client. My client did not pay any amount towards the settlement. In fact, he was reimbursed for the amount he previously paid me in retainer fees.

I had a client who received his third DWI. The first was over 15 years ago and his second was about 10 years ago. He was stopped at a sobriety checkpoint in Missouri. I was able to prevail at the administrative hearing since I proved that the officer failed to accurately follow all of the required procedures for administering and documenting the blood-alcohol test. He was able to keep his license. He also no longer drinks.

A client received numerous charges after a high speed chase while fleeing from the police, including speeding over 100 mph, careless and imprudent driving, following vehicles too closely, changing lanes when it was not safe to do so, failing to yield to an emergency vehicle, and resisting arrest. He could have been fined up to $3,300.00 and incarcerated for over 3 years. I was able to get all the charges dismissed except for the resisting arrest and speeding. He spent 8 hours in a holding cell ,received one year probation, and a fine for the speeding. He was ecstatic.

A client was arrested on a year old warrant for failure to appear in court for the felony charge of resisting arrest and driving without a valid license. I was able to get the $5, 000.00 bond waived and had him released on his own recognizance. I just got him a suspended imposition of sentence and probation. No jail time. If he behaves, he will not have any criminal record. He made a poor choice back then by driving and fleeing, but will not be branded as a criminal for the rest of his life. I love my job.

A creditor took a default judgment against my client a few weeks ago for a significant sum of money. While the process server said he served a member of her family, my client did not have any such family member in her household. I was able to get the judge to set aside the judgment and quash the garnishment on a bank account. It saved her about $4,000.00 in savings and a five figure judgment against her. It was wonderful to help her correct an injustice.

Met with prosecutors yesterday and got her to dismiss a citation for improper lane change, dismiss an improper tag charge, and reduced the charge of driving while suspended to a no point, non-moving violation. Saved my client 14 points on her license. She's one of my favorite clients.

I am going to get a charge of Driving While Intoxicated dismissed after the testimony and evidence of the arresting officer is suppressed. The officer lost "reasonable suspicion" to stop my client for driving with allegedly illegal license plates. After he stopped her, dispatch told him that the plates belonged to that vehicle. Any reasonable suspicion of criminal activity stopped and he had no authority to approach her vehicle or arrest her for DWI. NEVER SIMPLY PLEAD GUILTY TO AN ALCOHOL-RELATED OFFENSE.

What constitutes "possession" of a controlled substance? Being a passenger in a vehicle that has drugs or other contraband may not be sufficient to constitute possession.

It amazes me how some fathers (and some mothers) will complain about visitation with their children, yet not feel they should contribute to support their children. Unfortunately, visitation and child support are not dependent on each other. A parent cannot withhold visitation to the non-custodial spouse if they are late or even not paying child support.

The police must have probable cause to stop a driver. If there is no legal reason to stop a driver, but find criminal activity after they go to the car, I may be able to get any evidence derived from that stop suppressed. "Fruits from the poisonous tree" are inadmissible.
