ATTENTION REAL ESTATE AGENTS AND TITLE AGENTS!!!
I am calling attention to HB 569 / SB 394. The legislature is about to dictate who you will close your real estate transactions with.
Nearly all attorneys who own and operate Independent title agencies in Middle TN oppose this bill. Our custom and procedures have protected our Realtor colleagues and their clients for over 30 years. We’re a locally owned small businesses. Closing residential real estate is how we make our living.
The bill is brought by a handful of large operators in our business who want to use legislation to make closings easier and more profitable for them.

If the bill becomes law, sellers will pay new fees for services rendered for representation in their closings and increase the cost of closings overall. As an INTENDED consequence, many sellers will go unrepresented.
Local operations like ours—whose first priority is serving and protecting our customers and clients—will lose market share to non-local, non-attorney operators whose first priority is making more profit.
Key Provisions of SB 394 / HB 137
Authorizes the purchaser or borrower to select the settlement agent.
Restricted Attorney Role: While sellers may still retain a licensed attorney, the bill limits their role to specific tasks such as deed preparation, fee negotiation, and legal advice.
Prohibits sellers from requiring the use of a specific settlement agent as a condition of the sale.
