Jason Bach has long-term experience working with student rights issues, from his days as a student 25 years ago to today as a lawyer. His background in student activism naturally led to attending law school and working as an attorney handling education law issues. Education Rights Group is the culmination of a life-long passion for student rights. Bach and his team strive to protect the rights of

clients for fair and reasonable treatment in public and private institutions ranging from professional schools, including medical schools, to top-tier universities to local district elementary schools. Our Nevada-based firm represents professional students, graduate students, and undergraduate students at numerous schools around the country, some of which have included Baylor University, Georgetown University, Purdue University, Texas A&M University, and more. Back in 2023, the United States Supreme Court (SCOTUS) ruled that Harvard and the University of North Carolina (UNC) admissions policies considering an applicant's race violated the Constitution's Equal Protection Clause. What's happened since then?

Many schools are exploring new, race-neutral approaches that still recognize the personal challenges students overcome (socioeconomic hardship, discrimination, etc.) Part of this change includes restructured essay prompts that focus on these challenges.

Others are placing a greater focus on recruiting in high schools with large minority populations to generate more diverse applicant pools, which, in turn, means dropping legacy preferences.

For medical students and future applicants, these changes affect everything from how you tell your story on applications to how medical schools will build more diverse incoming classes.

As a medical student, you should express yourself to become the best version of yourself! But there is a point where practicing free speech could get you reprimanded by your school.

Med schools typically have policies regarding unprofessional conduct for their students, including the use of social media. Similar standards are found in hospitals, where professionals are expected to maintain a code of conduct.

A good rule of thumb: before exercising your freedom of speech, double-check if your desired goal could violate a school or hospital policy.

Do you need to submit an accommodations request for your clinical rotations? Nervous about it getting approved?

The key to having your accommodations request granted is whether you can safely meet the core skills of the clinical rotation. There are very real reasons as to why a school might deny a student accommodations. But students are often told “we don’t do that” when the law would say “actually, you probably should.”

Be sure to ask questions, appeal the decision, and build a medical career that works with you.

AI is reshaping schools, and tools such as ChatGPT and Gemini are challenging the academic integrity of the classroom. How can schools and students uphold academic honesty when technology can make dishonesty easier than ever?

Maintaining integrity is a shared responsibility. Schools should have transparent policies, ensure procedural fairness, and teach the ethical use of AI. Students should seek clarity on acceptable practices and adhere to them. We can protect academic standards and future professions by working together and using AI responsibly.
