Pedestrian safety is still a hard problem on Las Vegas Valley roads. KTNV reported that while overall fatal crashes were down at the time of its story, pedestrians accounted for about half of those killed, and Metro had logged more than 200 pedestrian-related crashes so far in 2026. Police point to distraction on foot, speeding, and drivers who fail to yield. Put the phone away at crossings, make eye contact with drivers, and use marked crosswalks when you can. After a crash, it's common to get a call within days from the other driver's insurance company asking for a 'quick recorded statement.' Before you agree, keep in mind that the adjuster works for the insurer, not for you. You aren't required to give the other driver's insurer a recorded statement. Offhand comments like 'I'm fine' or guesses about speed and distance can be used later to dispute your claim. It's okay to politely decline, give only your contact and basic information, and talk with a lawyer first. Get medical care, keep your records, and don't sign anything until you understand it. What should you do if a surgery, diagnosis, or treatment went wrong?

1. Get the care you need now, even if that means seeing a different provider.
2. Request copies of your medical records. You have a right to them.
3. Write down a timeline: dates, names, what you were told, and what happened.
4. Keep bills, prescriptions, and photos.
5. Don't wait. In Nevada, the deadline to file a medical malpractice claim can be as short as two years from when you discover the injury (and no more than three years from the injury itself).

On September 3, we argued for the plaintiff before the full Nevada Supreme Court, sitting en banc in Carson City, in State of Nevada v. District Court (Noury), Docket No. 91740.

The underlying lawsuit is a proposed class action alleging that the Eighth Judicial District Court, the CEO of its Administrative Office, and Clark County unconstitutionally kept the interest earned on interpleader funds held in the court's registry account, rather than returning that interest to the owners of the money at the end of the case.

The government defendants argue that NRS 355.210 authorized them to keep the interest and that NRS 41.032(1) makes them immune from suit. The district court largely denied their motions to dismiss, and they petitioned the Supreme Court to order the case dismissed.

The argument focused on two important questions:
• Can a statutory immunity bar claims that the government violated the Constitution?
• When money is deposited with a court in an interpleader case, who is entitled to the interest it earns?

We expect a decision by December.

Nevada's medical malpractice noneconomic damages cap rises again in 2026.

Under NRS 41A.035 (AB 404), the statutory limit on pain-and-suffering damages in med-mal cases goes to $590,000 this year, up from $510,000 in 2025. Economic damages such as medical bills and lost income are still uncapped. More scheduled increases follow through 2028.

Jacob Herman was 35 years old and less than a week from walking free.

On July 16, 2025, he was killed inside High Desert State Prison. The Clark County Coroner ruled the cause of death strangulation and the manner of death homicide. His cellmate — a man serving life without the possibility of parole for multiple killings — is identified by authorities as the person responsible.

Now Jacob's family has filed suit in Nevada's Eighth Judicial District Court against the State of Nevada / NDOC and prison leadership. The complaint alleges that:

🔹 Corrections officers were warned days earlier of an explicit threat to kill — yet Jacob was housed in that cell anyway

🔹 A soon-to-be-released man was placed with a violent, life-sentenced inmate

🔹 Chronic overcrowding and understaffing left Jacob with no protection

Jacob's family is seeking accountability so that no other family loses a loved one this way inside Nevada's prisons.
