Almost all courtrooms are shut down right now but arbitration’s have still been happening, although they are virtual. (An arbitration is a mini trial with 1 to 3 neutral people, usually retired judges, acting as the judge and jury. They decide the value of the case and then it’s over. It’s as stressful as a normal trial but usually cheaper and less time.)
My client was a first generation immigrant from Germany, and the daughter of a first generation immigrant from Jordan to Germany. The thought of missing work and jeopardizing her job as a bank teller scared her to death, or more specifically scared her to pain. She couldn’t bring herself to get all the treatment she needed because it would require her taking time off.
The defense attorney (who never met her before as his partner took her deposition a year ago) called her a liar, cheater, fraud, and actually said “you can tell she turned up the tear jerkiness for today.” He has never heard her speak yet felt empowered to say such terrible things.
I asked for past meds, future meds, past pain and suffering, and future pain and suffering and every single dollar of it, because even a cent less would be less than full justice. Defense attorney asked that she be given $6,000 “for her inconvenience.”
