Cobro de deuda

Incluso si tiene un fallo en su contra, para que el acreedor pueda cobrar la cantidad que se le otorga en el fallo, deberá intentar embargarle el salario o incluir su propiedad, aunque no toda la propiedad está disponible. Parte de su salario, el dinero de las cuentas bancarias y otro tipo de propiedad están exentos de ejecución.

¿Qué es propiedad exenta?

El capítulo 21 de la Ley de Nevada NRS, enumera la propiedad que está exenta de ejecución en Nevada. El artículo NRS21.090 dice que los ingresos exentos son:

Seguro Social, SSI, SSD
Ayudas públicas como TANF o vales de comida
Beneficios de desempleo
Sueldo disponible no superior a $362.50 a la semana
$1000 en cuenta bancaria
Beneficios de Veteranos de Guerra, Beneficios de Jubilados de Ferrocarriles, PERS (Sistema de Jubilación de Empleados Públicos), o FERS (Sistema de Jubilación de empleados del Gobierno Federal) o CSRS (Sistema de Jubilación de Funcionarios)
Compensaciones a los trabajadores
Ingresos por manutención infantil o de esposos.
Pagos recibidos de una muerte injusta o un acuerdo.


La propiedad exenta incluye;

Hasta un máximo de $550,000 de patrimonio neto de una finca (cuando autoabastece la finca)
Joyas, instrumentos musicales y otros recuerdos a no exceder $5,000
Artículos necesarios del hogar a no exceder $12,000
Maquinaria de granja, camionetas, inventario, herramientas y materiales no exceder $4,500
Herramientas, instrumentos, y materiales de cambio no exceder $10,000
Un vehículo con un valor menor de $15,000


¿Cómo demando una excepción?

Debe de presentar una declaración de excepción en el juzgado con 8 días de haber recibido el aviso de embargo o ejecución. Una copia de esta declaración debe ser entregada al alguacil (Sheriff) y otra al acreedor del fallo. Una vez entregado, al alguacil (Sheriff) deberá liberar la propiedad en 5 días a no ser que usted o el acreedor del fallo presenten una moción para tener una audiencia y determinar si en realidad la propiedad está exenta. A no ser que el tribunal mueva la fecha de la audiencia por causa demostrada y justificada, dicha audiencia será con 10 días de haber presentado la moción.



¿Acabo de recibir una demanda, que hago ahora?

Si usted cree que no debe la deuda o está en desacuerdo con la cantidad, necesita presentar una contestación con 20 días de haber recibido la demanda y el citatorio. Esta debe declarar porque no debe la deuda y cualquier defensa alternativa que usted cree que tiene. Si usted cree que el acreedor o la agencia encargada de cobrar la deuda hicieron algo ilícito al intentar cobrar la deuda, también debe presentar una contrademanda en contra de ellos al presentar su contestación a la demanda.

Si usted no contesta a la demanda o no se presenta a la audiencia, el acreedor podrá recibir un fallo en contra de usted por falta de comparecencia. Este fallo esta en efecto en Nevada por seis años y puede ser renovada por siempre.



Si usted debe la deuda puede elegir no contestar a la demanda. Un fallo en contra de usted, pero lo más probable que los honorarios de abogado serán menores que si hubiera contestado a la demanda. Lea arriba como el acreedor puede cobrarse una deuda por fallo judicial.



Las agencias de cobro de deudas siguen llamando pero toda mi propiedad está exenta, ¿Qué debo hacer para que dejen de ponerse en contacto conmigo?

Bajo el Acto de Practicas de Cobros De Justa Deuda (FDCPA), usted puede solicitar que la agencia de cobros de deuda deje de ponerse en contacto con usted. Todas las solicitudes deben tener fecha y estar por escrito, y asegurase de que mantiene una copia para usted. Después solo podrá ser contactado sobre cambios en su cuenta (Por ejemplo, si la deuda ha sido vendida o si el acreedor va a proseguir con el fallo en su contra).



¿Qué es lo que las agencias de colección pueden hacer para tratar de colectar la deuda?

El Acto de Practicas de Cobros De Justa Deuda (FDCPA) marca las reglas a seguir por las agencias de cobro de deudas. El FDCPA solo es aplicable a deudas a terceros, pero no lo es a acreedores a los que usted le debe deudas directamente. Si un cobrador de deudas le esta acosando, usted tiene las siguientes protecciones:



Usted no debe ser molestado en relación a ninguna deuda en momentos o lugares inusuales. Generalmente, cualquier contacto antes de las 8:00 a.m. o después de las 9:00 p.m. infringe el FDCPA.
Si su empleo prohíbe ser contactado en el trabajo por agencia de cobro de deudas, una vez que se lo comunique deben parar toda comunicación con usted en el trabajo.
Los intentos de cobro no pueden ser amenazantes, no le pueden amenazar con cárcel o con daño físico, o con divulgar a otros sobre su deuda para avergonzarle.
Si usted quiere refutar la deuda, puede notificarle al acreedor y solicitarle que le envíe verificación de la deuda por escrito. Usted debe de hacerlo con 30 días después de haber recibido aviso de la deuda. La agenciad de cobro de deuda debe verificarlo y proveerle con copia de esa verificación.

Change In The Insurance Law That Is Bad For Everyone Whether Injured In An Accident Or At Fault For An Accident

For many years there was a law in Nevada which required insurance companies to disclose the limits of their insureds to injury claimants, if the claimant either signed a medical authorization or provided bills and records. The idea behind this law was to promote cooperation between injury claimants and insurance companies in the claims stage. This made claimants aware of the amount of insurance available, and insurance companies were made aware of the nature of injuries and bills for claimants. Given this law, a great majority of all accident cases were settled in the claims stage because parties had two years to negotiate on the claim based on this exchange of information and documentation.

Some companies did not like this law though, because they believed that if a claimant and an attorney knew how much insurance was available the bills would be run up just so the claimant could get the insurance policy limits. Therefore, if the bills and records were sent in accordance with the law, the companies would only inform the claimant that the insurance was more than the Nevada State minimum insurance of $15,000 per person/$30,000 per accident/ and $10,000 for property damage. This promoted distrust by the claimants since companies were not willing to honor the law, and often a lawsuit was filed just to find out how much insurance was really available for the injury. In any lawsuit, the insurance policy limits have to be disclosed in the discovery phase of the case.

This past Spring the insurance industry was trying to radically alter the laws governing car accident cases in Nevada. The insurance companies tried to adopt California laws which would allow the companies to pay less on injury claims. The companies were upset about paying more in Nevada for the same injury than what they could get away with paying under California law. While the companies did not succeed in getting these new laws passed, they did succeed in repealing the law that required insurance companies to disclose their limits.

Now there is no law requiring the companies to disclose the limits of their at-fault drivers to injury victims in the claim stage. All adjusters are aware of this, and they have let it be known that records and bills can still be sent to them, but they are not going to reciprocate with the courtesy of disclosing the limits. Because of this, there will be an increase in the number of lawsuits for car accident cases, as there are many situations where claimants need to know how much insurance is available.

If an accident involves minor injuries, the limit amounts with insurance companies will not matter as much, as most likely the claim value will fall within the State minimum insurance limits of $15,000. With any accident of a more serious nature though, the only way to find out about insurance limits is to sue.

New law bans advanced fees for immigration reform work

Attorneys and immigration consultants are prohibited from collecting money for services related to federal immigration reform until Congress acts under a State Bar-sponsored law that went into effect last month.
The consumer-protection legislation, authored by Assemblywoman Lorena Gonzalez, D-San Diego, was introduced in response to reports from law enforcement that the federal debate over immigration reform was prompting scams aimed at undocumented immigrants.
Taking action to protect those at risk of being preyed upon was a top priority this year for outgoing State Bar President Patrick M. Kelly and incoming President Luis J. Rodriguez. The bar worked with the American Immigration Lawyers Association and other stakeholders on the final draft of AB 1159.
"We in California are fortunate to have bipartisan leadership that has come together to protect a vulnerable community," Rodriguez said.
The legislation went into effect upon Gov. Jerry Brown’s signature Oct. 5. In addition to prohibiting advanced fees for services related to the federal reform effort, the law also:
Requires attorneys and immigration consultants to account for any money already accepted for immigration reform services and either refund the money or deposit it in a client trust account.
Requires attorneys to inform clients receiving immigration reform act services where they can report complaints. A notice for attorneys to use has been posted on the State Bar’s website and is also translated into other languages, including Spanish and Chinese.
Increases the amount of bond that immigration consultants must carry from $50,000 to $100,000 as of July 1, 2014.
Prohibits the use of the term “notario,” which has been misconstrued as someone who is qualified to give legal advice.
Provides that a person who violates the ban on the use of the term “notario” is subject to a civil penalty of up to $1,000 a day for each violation.
A second State Bar-backed consumer protection measure was approved by the Legislature but vetoed by Brown. AB 888, authored by Assemblyman Roger Dickinson, D-Sacramento, would have allowed the bar to collect fines and penalties against those engaged in the unauthorized practice of law.
Brown’s veto message said existing enforcement mechanisms against the unauthorized practice of law are adequate. The Attorney General and local prosecutors have the power to bring civil and criminal actions with fines. The State Bar can seek civil injunctions.
The bar had argued that without the threat of sanctions, the targets of the bar’s civil injunctions are able to evade the bar by changing the name and location of their fraudulent operations.
State Bar CEO Joseph Dunn said the bar will work to address the governor’s concerns and reintroduce the legislation next year. Also, the Board of Trustees at its Oct. 13 meeting authorized the creation of a board committee to develop policy for the bar’s efforts to stop the unauthorized practice of law.
In addition, the State Bar’s annual fee bill was approved and signed by the governor. Active lawyers will be charged $420 and inactive members will be charged $145, with the ability to deduct up to $40 that goes toward funding various voluntary activities. The bills will be mailed in December and are due Feb. 3.
Attorneys are urged to make sure the bar has their correct address by looking up their online profile. Changes may be made online by going to My State Bar Profile.
At the request of the State Bar, the legislation also allows the bar to intercept state tax refunds to collect unpaid fines and penalties.

Obama's immigration move is a home run for Hillary Clinton

[...]The Obama immigration executive order, because it will be upheld or overturned by the next president, will now be a major issue in the 2016 presidential campaign. Clinton strongly supports the immigration executive order and will guarantee that, if elected, she will continue it. Every Republican running for president in 2016 will have to ask whether they will reverse the executive order, which will guarantee a huge Hispanic vote for Clinton and Democrats in 2016 and over the long term, or overturn it, which will be necessary for Republican candidates to avoid an intra-party war with the conservative base but will powerfully help Clinton with Hispanics in the 2016 general election.

I do not agree with the timing of the executive order. It would have been far better to let the lame-duck session finish its work on the budget and other pressing matters and then issue the executive order shortly before Christmas.

But make no mistake about it, the Obama executive order on immigration is a home run for Hillary Clinton and any Democrat running in 2016 who need Hispanic voters. Obama has set a political trap for Republicans, which they will walk right into, and even if the timing could have been delayed a few weeks, it creates a grand slam for Clinton and a disaster for GOP presidential candidates in 2016.
