A bi-partisan bill has just been passed in the Senate which allows victims of workplace sexual harassment to avoid being bound to forced arbitration agreements. If your employer has forced you to sign an arbitration agreement as a condition of employment, or if you are an employer who wants to implement an arbitration agreement, please call us to help navigate what can and cannot be included in those agreements.

The bipartisan bill bans employers from inserting provisions in contracts that require individuals who allege claims of sexual assault or harassment to go through a secretive process.

It's Election Day, Nevada! We want to remind you that under NRS 293.2546, you have the right to vote without being threatened, intimidated, or coerced. Additionally, NRS 613.040 prevents employers from prohibiting or preventing employees from engaging in political activity - including voting. This means that your employer cannot punish you because you voted and cannot threaten to terminate your employment, reduce your hours/wages, or discipline you if you don't vote a certain way. If you think your employer is violating your voting rights, give us a call or send us a message.

Something to remember among all the uncertainty right now: Regardless of what happens with your job and income going forward, employers MUST still pay employees for all work already performed. So any business conducting layoffs (permanent or temporary ones) must still pay their employees up through the date of the layoff.

With the new year came a number of new changes to some employment laws in Nevada. One of those changes is the addition of NRS 613.132 which states that an employer may not refuse to hire someone because that person tested positive for ma*****na on a pre-employment drug test (with some limited exceptions). However, this doesn't mean that once you are hired that you cannot thereafter be terminated. In the last legislative session, Nevada enacted a number of new laws related to employment policies which took effect on January 1, 2020. One of those laws is that employers may no longer refuse to hire a person who has tested positive for ma*****na on a pre-employment drug test.
