If you're struggling with bad auto loans one way to fix them may be through a Chapter 13 bankruptcy. In a Chapter 13 bankruptcy we may be able to reduce the balance of your loan through a process called a "Cram Down" and we can always reduce your interest rate down to a reasonable amount (currently 5%) and restructure your payment schedule.

The result of these items is often a savings on monthly payment of several hundred dollars - in many cases, the savings will more than off set your cost of filing bankruptcy. Yesterday, we filed a Chapter 13 case for a person who owed almost $10,000 on a car worth around $4,800. Her payment to her car lender was $340/month. Her interest rate was around 15%.
In a Chapter 13 case, we are able to restructure car loans to reduce the balance of the loan and reduce the interest rate paid on the loan. This is commonly called a "cram down".
Because of our ability to do so, we were able to reduce her car payment to $145.87/month - her total payment to the Chapter 13 Trustee will be $300/month ($40 less than her old car payment) and she will pay her car off in full and should receive a full discharge of her other debts (credit cards, medical bills, personal loans amounting over $28,000) in 36 months. We were able to file her case for her with $0 down.

Another side effect on the COVID crisis … laid off employees are losing health coverage and racking up major medical debts.

Once medical debts reach collections, they will effect your credit score and result in situations where your cost to finance other purchases will be increased.

Like credit cards and personal loans, medical debts (even in collections) are generally dischargeable in a Chapter 7 or Chapter 13 bankruptcy.
