Caregivers often ask why an attorney may need to speak with an elderly client alone.
The reason is simple: as attorneys, our duty is to the client and we must be sure their wishes are clearly understood and freely expressed.
A private conversation helps confirm capacity, informed consent, and independent decision-making. It also protects families by reducing the risk that documents could be challenged later.
This isn’t about excluding caregivers. It’s about protecting everyone involved.
