Pennsylvania DUI law doesn't require you to feel impaired. If your Blood Alcohol Content is above legal limits when tested, you're guilty - even 8 hours after your last drink.

We've defended Lancaster County drivers pulled over at 7 AM, driving to work, completely sober-feeling, who still tested above .08%. Alcohol metabolizes slowly. Heavy drinking the night before can leave you legally intoxicated the next morning.

Pennsylvania allows "third-party custody" when parents are unfit or when someone has acted "in loco parentis" (in place of a parent). Lancaster County courts set high bars for removing children from parental custody.

Third parties must prove parents pose a danger, or they've essentially raised the child with parental consent. Grandparents who've been primary caregivers while parents struggled with addiction have strong cases. Family friends who occasionally babysat don't.

These cases are emotionally devastating but sometimes necessary to protect children.
