USCIS officers are now being instructed to place greater emphasis on “discretion” when reviewing Adjustment of Status applications.

What does this mean?

Immigration officers may now more closely examine:
🔍 Why someone chose to apply inside the United States
🔍 Immigration history and prior entries
🔍 Ties to the U.S. and overall positive factors

Some cases are still being approved normally, while others are facing:
⚠️ More interview questions
⚠️ Additional scrutiny
⚠️ Requests for more evidence

Please do NOT panic. Every case is different.

USCIS has recently signaled that officers may begin applying greater scrutiny to Adjustment of Status cases involving issues such as overstays, unauthorized employment, or other immigration violations.

While USCIS appears to be encouraging officers to treat these factors more seriously, it is important to understand that immigration law still requires officers to evaluate cases individually and consider the totality of the circumstances.

In our view, immigration violations should not automatically outweigh all positive factors in a case. USCIS does have discretion in these cases and may consider immigration violations as part of a broader good moral character analysis. However, we believe many applicants with prior violations may still qualify for lawful permanent residence under existing immigration laws.

That said, applicants should expect:
❗ More Requests for Evidence (RFEs)
❗ More Notices of Intent to Deny (NOIDs)
❗ Tougher interviews
❗ Increased scrutiny of immigration history
