There are a lot of options for getting divorced these days. Not every divorce needs to cost an arm and a leg. You can be your own lawyer, hopefully with some knowledgeable coaching. You can fill out your own forms, but I recommend you have a family law attorney take a quick look at them before you file. You can even hire an attorney in the last 30 days or so, if settlement efforts fall through. I recommend you get an overview and some advice before you make those decisions. But know that the less hostility between spouses, generally the less legal fees paid. The first step in keeping your fees down is to keep your cool.

Maybe our problems aren't 100% the fault of everyone else. Maybe each of us needs to consider our own role when relationships go south. Especially relationships with our children. Parental alienation is a reality. But often the targeted parent handed the alienater some ammunition. One thing we can control is our own behavior, and how we react to situations. But if we refuse to even think about that possibility, we will never learn from our mistakes and are doomed to keep repeating history.

Sometimes an attorney for the children can make sure the children's voice is heard by the court...without dragging a child into court, and without the delay and expense of a custody evaluation. If your child writes to the judge requesting their own lawyer, the court is required to appoint someone.

Come in and talk to an experienced family law lawyer before you get started. You may be able to find the forms and fill them out on your own. But there's no substitute for the wisdom we gain after years of trying cases before our local judges, from seeing the after-effects (good and bad) on children as they grow, and from helping people pick their battles. You should start this process with as much info as possible.

If your New Year's resolution is to do something about a bad marriage, the best way to start is to educate yourself about the process. It can make a huge difference in the outcome if you know in advance what to do, and what not to do, from the very beginning. It helps to know the details and pitfalls ahead, preferably before you make a decision to leave or stay.

And while all of us hope for an amicable, cost-effective divorce, please remember that delays often help one spouse and hurt the other. So consider talking privately to a lawyer before starting the settlement process. The biggest risk in going straight into mediation, in my experience, is that it can drag out for months or even years. If, in the end, no settlement is reached, one of you will have to file and start what is typically nearly a year-long process. That's often hard on your pocket book and hard on your kids.

There's no down side to filing with the court first, and then working towards and amicable settlement, so long as everyone remains civil. But the upside can be significant...because it creates a deadline, in effect, to get the process done in order to avoid trial.
