It's a big win today in Crandall v. State of Oregon!!!!

In an opinion authored by Chief Justice Meagan Flynn, the Supreme Court ruled that a state immunity provision in the Oregon Tort Claims Act, which eliminated actions against state tortfeasors if the injured person is covered by Workers Compensation, violates the Remedy Clause of the Oregon Constitution. Many trial attorneys had their clients' cases on hold while they waited and hoped for this result. Their serious injury cases may now go forward. I also heard from other attorneys with catastrophically injured clients who may now pursue a recovery more fully responsive to their injuries because of this decision. THIS IS WHY WE DO WHAT WE DO.

It’s a Ninth Circuit win today in Groeneweg v. Jeld Wen Inc.

“We REVERSE the district court’s grant of summary judgment against Groeneweg’s common law negligence and ELL claims and otherwise AFFIRM. We REMAND for proceedings consistent with this memorandum.”

The client may now pursue his claims in the trial court and recover for his permanent and disabling injuries. Congratulations to trial attorneys Alexander Wylie Tim Williams who share in this win.

Plaintiff prevailed today in Stockert v. McLoughlin Place Operations, LLC, 337 Or App 672 (2025)! In this wrongful death case arising from nursing home neglect of a vulnerable elder, the trial court properly denied the defendant's motion to compel arbitration under an arbitration agreement signed by a family member lacking the authority to bind the decedent's estate to arbitrating its claims.

A victory today in the Supreme Court in Batten v. State Farm Mut. Auto. Ins. Co., (SC S067887). When an Oregonian is severely injured in damage amounts in excess of both the liability policy limits of the at-fault driver, and her own Underinsured Motorist (UIM) policy limit amounts, the UIM insurer may not limit its coverage to only one of several other UIM coverages available to its insured.

It’s been over 17 years. The plaintiff has finally obtained justice today after a second trial and this second round before the Oregon Supreme Court in Wright v. Turner.

After plaintiff obtained a second favorable jury verdict following the 2014 remand of this case by the Oregon Supreme Court, defendant insurer filed a second appeal and again obtained a decision in its favor from the Court of Appeals for which the Supreme Court allowed review. This past Friday, the case was argued and submitted for that Court’s second decision in this case.

Ms. Wright sustained her injuries in a multi-car collision in April 2004. A jury awarded her $979,540 in damages at the conclusion of her 2009 trial. Ms. Wright passed away during the pendency of this case, leaving her estate to continue this pursuit of justice and the recovery of underinsured motorist benefits required by Oregon law.

And she will be so remembered. Few jurists will ever match her unflagging commitment to and persistence in advancing civil rights and social justice. This loss was inevitable, yet the grief is palpable and overwhelming. May your memory be a blessing to all for many generations to come.
