Congratulations to Partner Valerie Chrissakis on another outstanding Motion for Summary Judgment win!
Plaintiff and his brother, through a limited liability company, were co-owners of an apartment building located in Beverly Hills, California. Plaintiff was performing maintenance on the apartment building and was injured when a ladder he was using slipped from its position causing him to fall to the ground.
Despite his status as a co-owner/shareholder and his role as the primary manager of the apartment building, Plaintiff sued his own limited liability company for negligence-premises liability. Defendant brought a Motion for Summary Judgment on the basis that Plaintiff, as an owner and manager of the apartment building who was at all times in control of the relevant ladder and all other relevant conditions on the date in question, bore responsibility for the alleged negligence which caused his injury and, therefore, could not recover against the entity.
The Court agreed, granting Defendant’s Motion for Summary Judgment in full!
