I had the pleasure of working with Kevin as an expert witness retained by my client in a case involving allegations of wrongdoing by a third-party off-duty police officer working a security detail at a business establishment. The issues in the case were broader than alleged negligence on the part of the police officer, and involved allegations of direct negligence on the part of my client. No matter, Kevin approached the case with his extensive knowledge and expertise and provided my client with essential expert opinion testimony. And he took his role a step further than most retained experts. He dug into the facts and evidence, and identified critical facts we had not thought of, which we were able to develop using Kevin's succinct, articulate, and thorough opinions and testimony. JUDGE ENTERS $2.97 MILLION AWARD AGAINST EMPLOYER RIVER SUB LTD d/b/a SUBWAY FOR FAILING TO PROTECT EMPLOYEE.
I wanted to share with you some great news that I just received about a wrongful death case against River Sub, Ltd d/b/a Subway in San Antonio. I was hired by the plaintiff’s lawyers-Watts Guerra, LLP of San Antonio - to be their expert witness in the arenas of: security, law enforcement, workplace violence, and foreseeability of domestic violence.

River Sub, Ltd. owns and operates 42 Subway shops in the San Antonio metroplex. The victim/decedent was a manager at one of their restaurants on Loop 410 and had worked for the company for over 12 years as a loyal and dedicated employee.

On February 16, 2020, decedent’s abusive ex-boyfriend kidnapped her at gunpoint from her apartment complex. He threatened to kill her and then himself, while snorting m**h, shot his gun inches from her head, but returned her to her apartment. Decedent reported this to her RiverSub manager, and immediately took steps to hide out from her ex-boyfriend after reporting the kidnapping to San Antonio Police Department.

Her district manager promised to assist, and decedent asked to be transferred to another Subway shop because her ex b/f knew where she worked. The district manager made an inquiry with H/R about transferring her but failed to follow through.

On February 28, 2020, her ex-boyfriend walked into the Subway store where decedent worked, chased her to the back of the store, and shot her several times. He fled the store where he killed himself in a field several hundred yards away. The victim, who had 4 adult children, died at the hospital several hours later that night.
After her murder, River Sub’s district manager “created” a written account of a conversation that he allegedly had with the decedent. In this highly questionable "memo" decedent's district manager claimed that just days before her murder he offered to move her to another store but she refused to do so, allegedly rejecting his offer to move her.

I testified, as plaintiffs’ expert witness on several issues, including security, workplace violence, and the foreseeability of the murder of the victim when an abuser has stalked the victim, owns a gun, displays a gun, threatens to kill the victim and himself, drug and alcohol abuse are present. The Danger Assessment risk prediction survey that I measured using Jaquelyn Campbell, RN and Johns Hopkins School of Nursing prediction scoring was measured at 23, with 18 being an “extreme danger of homicide.”

I am pleased to report that Judge Carlos Cortez (former District Judge of Dallas County) just entered his arbitration award in favor of the decedent's estate and her children awarding them $2,970,000 in damages against River Sub, Ltd.
