💰 Will your family owe estate taxes in Indiana?

Indiana no longer has a state inheritance or estate tax, but that doesn’t always mean an estate is tax-free. Certain assets may still be subject to federal estate taxes, capital gains taxes, or income taxes depending on the size and structure of the estate. (hereforlife.com)

Understanding how estate taxes work—and planning ahead—can help protect your assets and reduce stress for your loved ones later on.

👨‍👩‍👧 Do grandparents have custody or visitation rights in Indiana?

Grandparents play an important role in many families—but under Indiana law, parents are the only ones guaranteed custody by default.

That said, grandparents may be able to petition the court for visitation, but only in specific situations—such as when a parent has passed away, the parents are divorced, or the child was born out of wedlock (with paternity established).

Even then, the court will ultimately decide based on what is in the best interest of the child, while giving strong weight to the parents’ wishes.

👨‍👩‍👧 When a loved one can no longer care for themselves, what happens next?

Guardianship may be necessary when someone is unable to manage their health, finances, or daily care. In Indiana, a guardian is appointed by the court to protect the well-being and property of a “protected person.”

But guardianship isn’t one-size-fits-all. Options like limited guardianship, supported decision-making, or a health care representative may allow individuals to keep as much independence as possible.

Understanding your rights—and your options—is key in these complex and emotional situations.

⚖️ Public Defender or Private Lawyer—what’s the difference?

If you’re facing legal trouble, one of the most important decisions you’ll make is choosing the right representation.

A public defender is appointed by the court if you can’t afford an attorney, while a private lawyer is hired directly—often allowing for more time, resources, and personalized attention.

Both play critical roles, but factors like cost, availability, and level of attention can influence what’s right for your case.

💥 Pain and suffering goes beyond medical bills.

In a personal injury case, pain and suffering refers to both the physical discomfort and emotional distress caused by an injury—past and future.

These are considered non-economic damages, meaning they compensate for things like:
• Loss of enjoyment of life
• Anxiety or mental suffering
• Physical pain or long-term limitations

Unlike medical expenses, there’s no exact formula to calculate pain and suffering—making documentation and evidence critical to your case.

🐾 What happens to your pet if you become ill or pass away?

Pets are family—but without a plan, many animals end up abandoned or in shelters when their owners can no longer care for them. A pet trust can help prevent that by setting aside funds, naming a caregiver, and outlining exactly how your pet should be cared for.

With a pet trust, you can:
• Assign a trusted caregiver
• Appoint a trustee to manage the funds
• Provide detailed care instructions for your pet’s future

Planning ahead helps ensure your beloved companion is protected—no matter what happens.

💼 Are personal injury settlements taxable?

If you receive compensation after an injury, the good news is that most personal injury settlements are not taxable at the federal or Indiana state level. This typically includes amounts awarded for medical bills, attorney’s fees, pain and suffering, and many property-damage claims.

However, some parts of a settlement may still be taxed—such as punitive damages, lost wages, interest earned on the settlement, or compensation for emotional distress not tied to a physical injury.

Understanding how your settlement is treated can help you avoid surprises later.
