🚨Legislative Alert🚨 The legislature passed immediate amendments to Sections 5850 and 5855 of the California Civil Code, enacted through Assembly Bill 130, which was signed into law by Governor Newsom on June 30, 2025. Due to the nature of this legislative process, these changes are effective immediately and, among other things, place a cap on association fines of $100 per violation, except for violations relating to health and safety.

The CAI California Legislative Action Committee needs your help to OPPOSE AB 130! Assembly Bill 130 threatens the ability of homeowner associations (HOAs) to effectively govern their communities and maintain property values. By imposing a statewide cap on fines for rule violations, AB 130 overrides local control and undermines the rules that homeowners have voluntarily agreed to follow.

This bill limits HOA’s ability to deter violations, making it harder to preserve neighborhood aesthetics, safety, and quality of life.

If associations can’t enforce their rules, the cost of violations will shift to responsible homeowners—leading to higher fees and special assessments.

Current laws already require fines to be reasonable and follow due process. AB 130 is a solution in search of a problem.
