Wut? The indictment charges wire fraud for running a “smear campaign” against deplorable interests like neonazis and the K*K; is the US government seriously taking my the position that racists and violent extremists should not be smeared? The SPLC tactics, by the way, are entirely legal and exactly what federal investigators do to infiltrate criminal organizations and they are doing the good work the federal government is supposed to be doing by monitoring violent and racist extremists. This is the dumbest politically-motivated indictment ever and I expect it to either be dismissed or result in acquittal.

Yet Wisconsin, including several jurisdictions where we regularly practice, continues to aggressively prosecute and incarcerate nonviolent ma*****na offenders. The distinction between 'legal' ma*****na regulated by the federal farm bill (until November, when that sunsets) and 'illegal' ma*****na that is often home-grown/organic, is a legal fantasy that leads to disproportionately incarcerating and making criminals out of people of color. Re**er madness keeps Wisconsin in the 1920's, while most of our neighbors have legalized, regulated, and taxed ma*****na products with zero impact on their public safety. We'll keep representing people charged with ma*****na offenses, but my hope is that by the time I retire there won't be a need for it.

Correct. There is no such thing as "federal immunity" for violating state laws, including the two murders that ICE agents committed on camera in Minneapolis. And no, the current administration cannot prosecute Hennepin County prosecutors for investigating and criminally charging federal employees. We need more community-based employment programs for state prison inmates, the vast majority of whom are nonviolent drug offenders and intoxicated drivers. Teaching job skills, providing certifications, and reference letters are significant steps toward keeping released inmates compliant with supervision. I couldn't find any wage and hour data for this program, but since the position exists outside the institution, participating inmates should also be paid at least minimum wage—a significant step up from eleven cents an hour—allowing them to build a nest egg before release.

A partnership between the Mississippi Valley Conservancy and the Prairie du Chien Correctional Institution is restoring land while helping incarcerated individuals build job skills for life after release.

What is the point of this? Taking an exam on model statutes and restatements of law worked in law school because students learn the basics of legal analysis at that point. But the uniform exam is not specific to Wisconsin law, which oftentimes does not mirror the model statutes or restatements of law. So bar applicants are studying for a test that tells them nothing about practice in the state they are being admitted.

I've long been a proponent of requiring an examination for Wisconsin attorneys. And I say that as an attorney who was admitted via the diploma privilege, where we were instructed on Wisconsin law in law school and had to complete the required coursework in order to qualify. When a client's freedom is in your hands they should have confidence that their counsel was able to pass a basic examination on the law of this state. But this solution makes zero sense.

No, no, no. This is a really bad idea. The right to an interpreter who ensures that a defendant understands what is happening in court isn't just statutory, it stems directly from Constitutional due process rights. And while AI might occasionally work outside of court, when somebody's freedom is on the line, potentially for years, they have every right to understand exactly what is happening in court.
