It is a difficult step having to relocate to an assisted living facility in the first place, but to have this happen is just unconscionable!

According to this article, Ms. Pols was told they she could continue to live at this assisted living facility after she qualified for Medicaid benefits, as long as she paid out of pocket to reside at the facility for the first six months. This promise was never made in writing or signed. Once she got on Medicaid, she got the boot, despite living up to her end of the bargain!

Lesson learned: call one of our attorneys to discuss your estate plan!!

The woman's discharge is part of what appears to be an increase in assisted living dismissals stemming from low Medicaid reimbursement rates.

This probably doesn’t fall under the category of a “slip and fall” case... Maybe a “fall on slip sign” case. Or a “generous jury” case would apply too. It shows how a good lawyer can make all the difference!
