Who can be a witness to a notarial act

---A witness cannot be a party to the notarial act or cannot be personally bound by the notarial act.
---Can be any person of understanding about the act witnessed.
---Can be a person of any age as long as that person is capable of understanding their role as witness.
---Relatives can be witness unless bound by the notarial act or except where prohibited by law.
---Witness must actually witness the act and intend to witness the notarial act.

Two competent witnesses are required for notarial acts requiring witnesses (notarial acts can require one depending on specific statute). Most notarial acts by statute either require 2 or 0 witnesses to be valid.

Act of Donation

Affidavit of Heirship

If the legal movable owner dies (name on title) and no judicial succession is opened, possession and legal title can be obtained by filing an "Affidavit of Heirship" by the surviving spouse, heirs, or both. Affidavit of Heirship is form DPSMV 1696. This form needs to accompany a death certificate or copy of obituary, and must be signed in the presence of a notary. Check with OMV to see what other documents are needed for the desired transaction.
