DHS ENDS AUTOMATIC E.A.D. EXTENSION
29-Oct-2025

The Department of Homeland Security has announced a final rule that will end the practice of automatically extending employment authorization documents. Aliens who file to renew their E.A.D. on or after 30-Oct-2025 will no longer receive an automatic extension.

IMPORTANT: We urge all aliens with an E.A.D. to check its expiration date. Ideally, aliens should file to renew their E.A.D. up to 180 days before its expiration.

Before, while USCIS was reviewing an EAD extension, the beneficiary would automatically receive an extension worth hundreds of days. As such, the worker could continue working while their E.A.D. renewal was being processed. That is no longer the case, and as soon as the E.A.D. expires, the worker should stop working.

There are a few narrow exceptions to the above, such as certain workers under Temporary Protected Status (TPS). As such, it is safest to assume that most cases will not extend automatically.

O Departamento de Segurança Interna dos EUA (DHS) anunciou uma regra final que encerrará a prática de estender automaticamente os Documentos de Autorização de Emprego (E.A.D.). Estrangeiros que solicitarem a renovação da E.A.D. a partir de 30 de outubro de 2025 não receberão mais a extensão automática.

IMPORTANTE: Recomendamos que todos os estrangeiros com E.A.D. verifiquem a data de validade do documento. Idealmente, a renovação deve ser solicitada com até 180 dias de antecedência da data de expiração.

Anteriormente, enquanto o USCIS analisava a solicitação de renovação do E.A.D., o beneficiário recebia automaticamente uma extensão válida por centenas de dias. Assim, o trabalhador podia continuar exercendo suas atividades enquanto aguardava a renovação. Isso não é mais permitido, e assim que o E.A.D. expirar, o trabalhador deverá interromper suas atividades.

USCIS CHANGES METHODS FOR PAYING FEES

USCIS has just announced that, as of August 29, 2025, USCIS fees may also be paid through electronic debit from a U.S. bank account by filling out Form G-1650.

Currently, fees can be paid through checks, money orders, credit and debit cards (linked to a U.S. bank account and by using Form G-1450) and now Automated Clearing House (ACH) transactions as well.

IMPORTANT: From 28-Oct-2025 onwards, USCIS will only accept payment via ACH debit transactions (Form G-1650) and cards (Form G-1450), unless an exception applies. That is, payment via checks or money orders will become the exception.

USCIS is not supported by taxpayer’s funds, but by the fees it charges for its services. It is thus very strict in this regard. Failure to submit the appropriate fee at filing will usually result in a case’s rejection (or, if lucky, a warning to submit the correct payment).

USCIS does not accept payments from foreign banks. All payments must be from a U.S. bank and in USD. USCIS does not accept payments in cash.

Until recently, USCIS would accept payments via money orders and checks. This was the preferred method of payment for many petitioners, given their lack of access to U.S. bank accounts. Starting in October, that is likely to change. Heeding an Executive Order pushing for modernizing the U.S.’s payment methods, USCIS is trying to go paperless, at least insofar as its fees are concerned.

The first change is the acceptance of ACH payments, which are direct debit transactions between USCIS and a U.S. bank. This can be done via Form G-1650 or online, at Pay.gov.

The second change, as mentioned, is a push to stop receiving checks and money orders.

This will leave petitioners unable or unwilling to open a U.S. bank account with some options:

- Having someone (like your attorney) pay on your behalf
- Requesting a paper payment exemption (Form G-1651 – limited cases)
- Using a prepaid card linked to a U.S. bank (Form G-1450)

In any case, always take care to fill out all information accurately, ensure there are sufficient available funds and warn the bank not to block such transactions.

Em nosso vídeo recente sobre o Presidente Trump e EB2-NIW (disponível aqui: https://youtu.be/8_UOMPBt8bA?si=HXKpwCbUN7-qSWur) comentamos que, não obstante a linguagem forte do presidente contra imigração, Donald Trump tinha, no passado, feito uma distinção entre imigração legal e Ilegal, tolerando ou até encorajando o tipo legal.

Agora, em recente entrevista à NBC (disponível aqui: https://www.nbcnews.com/politics/2024-election/trump-says-no-price-tag-mass-deportation-plan-rcna179178), o Presidente-eleito voltou a reforçar essa distinção: “Queremos que as pessoas entrem [...], mas elas têm de vir com amor ao país. Elas precisam entrar legalmente”.

Esse esclarecimento é um bom sinal para aqueles buscando meios legais de migrar para os EUA, como é o caso dos pleiteantes de vistos EB2-NIW. Seguiremos acompanhando o Presidente-eleito e ficamos na torcida por mais sinais de uma política pró-imigração (legal)!

In our previous video about President Trump and EB2-NIW (available here: https://youtu.be/8_UOMPBt8bA?si=HXKpwCbUN7-qSWur), we noted that, notwithstanding his strong rhetoric against immigration, President Trump had, in the past, seemed to differentiate clearly between legal and ILlegal immigration, tolerating or even encouraging the former.

Now, at a recent interview for NBC (available here: https://www.nbcnews.com/politics/2024-election/trump-says-no-price-tag-mass-deportation-plan-rcna179178), the President-elect once again made this distinction, noting: “We want people to come in […] but they have to come in with love for the country. They have to come in legally.”.

This should come as a relief to all those seeking legal entry to the U.S. through such visas as the EB2-NIW. We will continue to monitor the situation and hope for more encouraging signs from the new president!

Attention Adjustment of Status Applicants:
In April 2024, USCIS announced a new rule increasing the automatic extension of the expiration date printed on the Employment Authorization Document (EAD) of certain applicants. To these applicants, the expiration date would be extended by up to 540 days while their application is pending. This rule applies to those who, among other requirements, filed their Form I-765 (Application for Employment Authorization) to renew their EAD before the expiration date printed on the EAD.

If you own a company, you might be able to transfer yourself to the U.S. to live and work there under the L-1 visa.

The L-1A Visa enables a U.S. employer to transfer an executive or manager from one of its affiliated foreign offices to one of its offices in the U.S.

This type of visa allows investors to open an affiliate or subsidiary of their company in the U.S. and transfer executives to oversee the operations of their new business entity in the U.S.

The “L-1A new office” (the newly formed company in the U.S.) can petition on behalf of the executive or manager to be temporarily transferred to the U.S.
