Proposed Change to Custody Factors passes in the house.

My colleagues and I passed legislation that streamlines child custody factors from 16 to 12. As a longtime advocate of 50-50 custody, I’m pleased to share than an amendment I proposed, which would require family courts to provide anyone named in a custody petition with a written copy of the new factors when decisions are made, passed unanimously.

Child custody factors are circumstances the courts are supposed to consider surrounding a child’s welfare, from adequate supervision to safe living conditions, access to health care, emotional support, stability and more.

When both parties understand the criteria used by our courts, misunderstandings can be avoided and settlements aligned with the child’s best interests can be reached in a more fair and accurate way.

Thanks to the efforts of our legislators, especially our very own, Senator Lisa Baker, Kayden’s Law has passed in the House and the Senate. The passage of the bill strengthens the factors the court must review when awarding custody and emphasizes the most important issue during custody proceedings is the protection of the child.
