On Friday after a week long trial, an Ulster County Supreme Court jury reached a verdict in favor of a Kingston woman, resulting in her being awarded $2,000,000.00.
The award was to compensate her for injuries she suffered when she was struck by a commercial pickup truck that was pulling out of a driveway as she was walking on the shoulder of the road. As a result of the collision the Plaintiff sustained injuries to her left leg which required surgery.
Prior to trial, Selective Insurance, the insurance company for the commercial vehicle, offered $300,000 to settle, claiming that the collision was mostly the fault of the Plaintiff.
The offer was rejected, the trial proceeded and throughout the trial, Defense continued to make the argument that the Plaintiff was at fault for being hit by the truck.
After a 5 day trial and nearly 4 hours of deliberations, the jury returned a unanimous verdict awarding the Plaintiff $2,000,000.00, over 6X more than Defendant’s settlement offer. Defense counsel who tried the case for Selective Insurance Company were from offices in Albany and Westchester New York.
