✅ Answer: The notarization must be postponed until the signer can present an acceptable form of identification or another legally authorized method of identifying the signer is available under your state's notary laws.

As a notary, you cannot proceed if you are unable to properly identify the signer. Verifying identity is one of your most important legal responsibilities and helps protect everyone involved from fraud.
💡 Pro Tip:
Before every appointment, remind signers to have their valid, government-issued photo ID ready. A simple reminder can save time and prevent delays.

✅ Answer: No. Texas law sets the maximum amount a notary public may charge for each notarial act. You cannot charge more than the authorized fee for the notarization itself.

However, if you’re a mobile notary, you may charge separate fees for additional services such as travel, printing, scanbacks, shipping, or other agreed-upon services—as long as those charges are clearly disclosed and itemized separately from the notary fee.

💡 Notary Tip:
Always be transparent with your clients. Clearly explain your fees before the appointment and provide an itemized invoice when requested.

❓Question of the Day: What if the signer doesn't have an ID but has a witness?
✅ Answer: No. In Texas, a witness generally cannot serve as a substitute for proper identification. Unless you personally know the signer or the signer presents acceptable identification, you should not proceed with the notarization.
💡 Notary Tip:
Never rely on a friend's, family member's, or coworker's statement to identify a signer. Proper identification protects the signer, the public, and your notary commission.

For a Texas Notary, the answer is generally no.

A witness cannot simply replace a signer's identification if the signer has no valid ID.

Texas law allows you to identify a signer by:

Personal knowledge (you personally know the signer), or
A current government-issued identification card or document that contains a photograph and signature (or meets Texas requirements).

If the signer has no acceptable ID and you do not personally know them, you should decline the notarization until they can present proper identification.
