When Victims Become the Ones in Handcuffs
One of the greatest dangers in domestic violence cases is the misidentification of the primary aggressor. Abusers often appear calm, collected, and rational when law enforcement arrives, while the actual victim may be emotional, frightened, crying, anxious, or dysregulated from the trauma they have been experiencing. Too often, those trauma responses are misunderstood, and the victim ends up being treated like the offender.
The heartbreaking case of Gabby Petito is a powerful example. In August 2021, Utah officers responded to a domestic disturbance involving Gabby and her fiancé, Brian Laundrie. Body camera footage showed Gabby visibly distressed and emotional, while Laundrie appeared calm and composed. Officers ultimately determined that Gabby was the primary aggressor.
Weeks later, Gabby was murdered by Laundrie. Subsequent reviews of the incident found mistakes were made in the handling of the domestic violence investigation and highlighted the need for additional domestic violence training for law enforcement.

Domestic violence is complex. Victims do not always look like victims. Trauma can cause fear, panic, confusion, emotional outbursts, and behaviors that are easily misinterpreted by those who do not understand the dynamics of abuse. Meanwhile, an experienced abuser may appear calm, polite, and cooperative.
