🚨 SCAM ALERT from Kern River Legal Services 🚨

At Kern River Legal Services, we handle a high volume of probate, real estate, and business matters. One thing we constantly remind our clients is this:

👉 If you receive anything unexpected related to your case, property, or filing—contact us immediately.

We can only protect you (and the work we’ve done for you) if we know what’s going on. And just to be clear—we don’t bill for quick calls to review something suspicious, so please don’t hesitate to reach out.

Recently, one of our clients received a letter like the example below—and unfortunately, we see these all the time.

Here’s how the scam works:

After you record a deed or file with the Secretary of State, your information becomes public
Scammers use that information to send official-looking letters
These letters often include seals, formal language, and even disclaimers to appear legitimate
⚠️ But make no mistake—it’s a scam.

They’re typically asking for around $100+ (in this case, $128) to send you a document you already have—a copy of what you just filed.

Bottom line:
✔️ Don’t pay for copies of documents you’ve already recorded
✔️ Be cautious of unsolicited mail related to your legal matters
✔️ When in doubt, call us—we’re here to help

Stay safe and be mindful of who you’re sending money to!

As an attorney, I am unapologetically in favor of people and businesses using bankruptcy laws to get a true fresh start.

Let’s be honest for a moment.

Estate planning comes with a LOT of “hats.” 🎩

When creating an estate plan, you may name different people (sometimes the same person) to different roles:

• Attorney-in-Fact (Power of Attorney)
• Health Care Agent (Advance Health Care Directive)
• Executor (Will)
• Trustee (Trust)
• Beneficiary

Each role has different powers and responsibilities — and one role should not be used to act under another. For example, your Attorney-in-Fact should not act as your Trustee unless the Trust specifically allows it.

Here’s where it often gets confusing 👇
Many people name one trusted person (often a spouse) to multiple roles. While this is common, it can feel overwhelming when it’s time to act.

A simple way to stay on track?
Ask yourself: “What hat am I wearing right now?”

Am I acting as:
• Trustee?
• Executor?
• Agent?
• Beneficiary?

Identify the role, then act only within the authority granted by the document for that role.

Understanding these distinctions can help avoid costly mistakes and unnecessary stress — and it’s a key part of smart estate planning.
