Recent USCIS Policy Guidance Regarding Adjustment of Status Applications

USCIS recently issued updated policy guidance regarding Adjustment of Status (“AOS”) applications filed within the United States. The guidance emphasizes that Adjustment of Status is a discretionary benefit under Section 245 of the Immigration and Nationality Act and that USCIS officers may consider the totality of the circumstances when reviewing these applications.

Importantly, this does not mean that Adjustment of Status applications will automatically be denied or that applicants currently pursuing permanent residence in the United States are no longer eligible to do so. Rather, USCIS is signaling that officers may apply increased discretionary review in certain cases.

At this time, the guidance appears primarily directed toward cases involving negative discretionary factors, immigration violations, or situations where USCIS believes consular processing may be more appropriate. Applicants with strong equities, lawful status history, valid immigrant petitions, and properly documented applications should still be eligible to pursue Adjustment of Status.

We understand that announcements such as these can cause concern; however, it is important not to panic. Immigration policy guidance often evolves, and we are working closely with the American Immigration Lawyers Association and actively reviewing the memo and preparing additional analysis and practice guidance for our clients.

Our office is closely monitoring developments and will continue to advise clients regarding any material changes that may affect their cases.
