Missouri appeals court revives two breach-of-contract claims from a former UMKC student challenging how the university calculated his science GPA.

On August 4, the Missouri Court of Appeals reversed the dismissal of part of our client's breach of contract case against the University of Missouri and sent the case back for further proceedings. Our client alleged that, after UMKC required him to enter an alternate curriculum in its six-year B.A./M.D. program, the University promised that repeated science courses and additional biology courses would be counted in calculating his science GPA, but it later refused to count them as promised. The Court of Appeals agreed with us that those allegations identified specific, enforceable contractual promises rather than merely general or aspirational university policies. It also agreed that those claims were timely because our client couldn't have known the University would refuse to honor those promises until he was notified in 2013. The Court allowed the two GPA-related claims to proceed. The case is Carter v. Curators of the University of Missouri, No. WD87975.

Today, the Kansas Court of Appeals reversed all 17 of our client's convictions for violating a "protection from abuse" order based on communications he sent to the protected party and ordered a new trial. The Court agreed with us that the district court abused its discretion by denying our client's request for a bill of particulars, which would have required the prosecution to identify the specific messages on which it relied in charging him. Because the prosecution brought the charges based on hundreds of communications exchanged over a year, the Court agreed with us that our client was improperly left guessing which messages allegedly constituted crimes and how the prosecution claimed they violated the order. The case is State v. Bee, No. 128,336.

Today, the Supreme Court of Missouri agreed to transfer a land use appeal on Jonathan Sternberg's application. The case concerns a claimed prescriptive easement over private property in Kansas City, which the property owner challenges. The Missouri Court of Appeals, Western District, did not reach the merits and instead dismissed the appeal, holding that an amended judgment was void because it was electronically filed three minutes after an order denying a post-judgment motion. The Supreme Court will now rehear the appeal. Jonathan previously has argued 17 cases before the Supreme Court. The case is 200 W Armour Boulevard, LLC v. Judson, No. SC101621.

Bill received his law degree from the University of Kansas in 2017, where he graduated in the top 10% of his class, and received his undergraduate degree from Dartmouth College in 2008. Today, the Kansas Court of Appeals reversed a dismissal of our client's neglicence claim for against a pizza delivery company after our client settled with the employee-driver. The client was injured when the driver struck him while he was riding a bicycle. The Court agreed with us that under Kansas law, a general release that does not specifically identify an employer does not extinguish the employer's liability for its own independent negligence, and that boilerplate language alone is insufficient to do so. It remanded the case for further proceedings on that claim. The case is Szerwinski v. Main Street Associates, Inc., No. 128,438.
