Today, the Supreme Court of Missouri agreed to transfer a land use appeal on Jonathan Sternberg's application. The case concerns a claimed prescriptive easement over private property in Kansas City, which the property owner challenges. The Missouri Court of Appeals, Western District, did not reach the merits and instead dismissed the appeal, holding that an amended judgment was void because it was electronically filed three minutes after an order denying a post-judgment motion. The Supreme Court will now rehear the appeal. Jonathan previously has argued 17 cases before the Supreme Court. The case is 200 W Armour Boulevard, LLC v. Judson, No. SC101621.

Bill received his law degree from the University of Kansas in 2017, where he graduated in the top 10% of his class, and received his undergraduate degree from Dartmouth College in 2008. He previously practiced as a litigation attorney for several different firms, including a large national firm, handling complex civil matters across the country. Welcome, Bill!

Today, the Kansas Court of Appeals reversed a dismissal of our client's neglicence claim for against a pizza delivery company after our client settled with the employee-driver. The client was injured when the driver struck him while he was riding a bicycle. The Court agreed with us that under Kansas law, a general release that does not specifically identify an employer does not extinguish the employer's liability for its own independent negligence, and that boilerplate language alone is insufficient to do so. It remanded the case for further proceedings on that claim. The case is Szerwinski v. Main Street Associates, Inc., No. 128,438.

We're hiring an associate attorney for our Downtown Kansas CIty office.

We represent businesses and individuals in complex civil and criminal appeals and related litigation in state and federal courts throughout the country.

The associate’s responsibilities will include compiling and analyzing trial and administrative records, researching legal issues, drafting appellate briefs and motions, assisting with hearings and oral arguments, and supporting other litigation matters as needed.

The position offers the opportunity to work extensively on appeals and related litigation, and to develop advanced research and writing skills in a demanding but collegial environment.

Candidates must:
• have at least two years of litigation experience, demonstrating a stable work history
• be licensed and in good standing in both Missouri and Kansas
• possess excellent analytical, research, and writing skills
• demonstrate strong organizational and time-management ability
• be proficient in Westlaw, Microsoft Word, Outlook, and Adobe Acrobat

Experience with appellate litigation and criminal post-conviction proceedings is strongly preferred.

Today, the Supreme Court of Missouri reversed a judgment granting visitation of our client's adopted children to a former co-guardian who was the unsuccessful party in the adoption. The Supreme Court agreed with us that Missouri's child custody statute does not create an independent cause of action for third-party custody or visitation when custody already has been awarded and overruled prior appellate decisions holding otherwise. It ordered the third-party visitation case dismissed. This was the best possible result for our client. The case is In re A.L.P., No. SC101121.

This week, a state judge in Lyon County, Kansas, vacated our client's life sentence in a first-degree felony murder case following a two-day evidentiary hearing on a post-conviction motion. The Court agreed with us that the client's trial counsel rendered ineffective assistance by failing to invoke Kansas's statutory mental-health sentencing procedures, which would have required a presentence evaluation for possible commitment to a state mental-health facility in lieu of confinement in light of the client’s documented mental health history. The Court set aside the sentence and ordered resentencing following a proper statutory mental-health evaluation. The case is Mitchell v. State, No. LY-2025-CV-000004.

For the fourth consecutive year, Missouri Lawyers Media has named Jonathan Sternberg to its year-end "Top 100 Power List" of the top attorneys in Missouri. Jonathan is again the youngest of the ten lawyers recognized for appellate practice, a group that includes two former judges of the Supreme Court of Missouri, a former judge of the Missouri Court of Appeals, and a former Solicitor General of Missouri.
