There is a big difference between telling an insurer you want a claim resolved and making a settlement demand that can later become part of a bad faith claim.

That distinction became important in Bristol Springs Custom Homes, LLC v. Argo Group US, Inc., a recent Fourth Circuit decision involving a construction-defect dispute, an insurance judgment and allegations that the insurer failed to settle.

Businesses send wire payments every day with little reason to question where the money is going, especially when the instructions appear to come from someone they've worked with before.

That assumption became the center of the dispute in Progressive Laboratories, Inc. v. Living Fuel, Inc. After a hacker intercepted an email conversation and sent fraudulent wire instructions, more than $130,000 ended up in the wrong account. The payment was real, but the debt remained.

Winning a business dispute takes more than having the facts on your side.

In Deque Systems Inc. v. BrowserStack, Inc., claims for more than $30 million unraveled because the plaintiff failed to properly disclose how those damages were calculated during discovery. The court also made clear that asking for an injunction isn't enough if there's no evidence the conduct is continuing.

The decision is a reminder that strong claims can still fail when discovery obligations aren't taken seriously.
