Michigan is a gorgeous place to live & work, especially in summer!

But some of that natural beauty can be naturally distracting to other drivers ...

And it's impossible to tell which ones!

According to the MSP's 2021 crash report (their latest published report), distracted driving causes more accidents than DUIs do ...

To avoid being part of the problem (and keep yourself and other drivers safe), remember:

• The Michigan hands-free driving law went into effect on June 30. That means NO hands-on contact with your phone except in a true emergency.

• NO calls or texts with your phone in your hands.

• Only refer to your digital instrumentation when completely stopped. It's too easy to get distracted by glares & shadows, small type, dust & other distractions that take your eyes off the road!

• Wear sunglasses & use your visor in sunny weather, especially at dawn dusk. The sun's lower angle make these driving times riskier than others.

• Don't play your radio louder than a level that lets you hear what's going on around you. You need eyes AND ears on the road!

• When driving with children, plan simple activities that can keep them busy and quiet in the back seat, even on short trips.

If all drivers practice safe driving disciplines, fewer accidents causing injuries will result.

The State of Michigan has been working for years on its "Toward Zero Deaths" initiative to prevent traffic deaths, including in work zones.

As a personal injury attorney for over 30 years, I've seen first hand the horrific injuries and yes, even deaths, caused by work zone accidents.

So I feel compelled to join MDOT in educating drivers about work zone safety.

While the statistics are startling (nearly 4400 work zone crashes in '22, causing 862 injuries and 13 deaths), the good news is, educated drivers can make a huge difference.

Here's how:

1. Distracted drivers are the leading cause of work zone crashes. The fix? PAY ATTENTION TO THE ROAD. Don't send a quick text because you're stuck in traffic.

2. SPEED is another major crash contributor. The fix? SLOW DOWN. Reduced speeds are in effect FOR A REASON.

3. Most work zone crashes happen during daylight hours. The fix? See points 1 & 2 above!

4. More work zone crashes happen from May - Dec (obviously, more crews are out then!). The fix? Plan extra time or pack extra patience; chances are, you'll run into construction delays in Michigan during these months!

5. Perhaps the biggest reason to take construction zones seriously? The people MOST likely to be injured or killed in a construction zone accident aren't construction workers:

They're regular drivers like you & me and their passengers.

A pretty sobering thought.

Please - come home safe. Give work zones, their workers, speed rules and common sense the respect they deserve.

I have to tell you, I live on an inland lake in west Michigan ... so I've seen some really crazy things, lucky breaks, and horrific watercraft accidents in my time!

Whatever kind of watercraft you enjoy – from speed boats to pontoons, jet skis to kayaks – it takes just one split second to turn a great day into a tragic one.

Often there's little you can do about the other guy's conduct ...

But you CAN increase your odds of a great, safe day on the water by following these tips:

1. WEAR YOUR LIFE PRESERVERS! They can't help you if you're hurt and they're stored beneath the seats!

2. LEAVE PARTYING ON THE BEACH! Don't operate any type of watercraft if you've been imbibing. It dulls the senses, slow reaction times, and can put the responsibility for an accident on YOU.

3. OBSERVE LOW WAKE AND SPEED ZONES: these rules exist to PROTECT you. Violating them is a foolish risk.

4. CHECK THE WEATHER FIRST: it's unpredictable. Bring the proper clothing and gear for the day's forecast, or plan to come back before the weather shift is expected.

5. STOW YOUR PHONE: it may be helpful if your craft drifts or is damaged, but texting and calling from it are unnecessary & risky distractions.

6. KEEP AN EYE OUT: it's not hard to tell who's getting out of control on the water. AVOID individuals & groups that are too loud & disruptive.

Having a watercraft is great fun in Michigan! It's also a great responsibility.

Here's the thing, though ...

90% of all motorcycle accidents are caused by the OTHER driver failing to yield the right of way.

Which means no matter how confident you are in yourself, you can't afford to have confidence in the OTHER guy!

Here's the other thing: YOU know the wreck wasn't your fault!

But KNOWING it and PROVING it to the involved insurance companies are TWO VERY DIFFERENT THINGS!

Insurance companies are out to KEEP their money, NOT pay it out in claims!

Keep yourself safe while cycling on our Michigan roads by following these tips!

Remember, any accident you get in is all about proving who is at fault, so it's important to cover all your personal cycling safety bases!

Follow these tips for safety AND for minimizing the chance of negligence claims against YOU if you're struck by a motor vehicle:

1) Wear a safety-rated helmet. 8,300 cyclists are hospitalized with head injuries every year!

2) Wear something colorful. It makes it easier for motorists to spot (and avoid hitting) you.

3) Use flashing lighting devices to make you more visible to drivers approaching from behind.

4) Don't use headphones. Cycling may be a great time to catch up on podcasts or your favorite tunes, but they prevent you from hearing approaching vehicles as well as you could.

5) Use both straps if you're carrying a backpack. It's too easy to get thrown off balance (especially when swerving to avoid hitting something or being hit!). Not doing so can definitely be used against you if you're struck!

6) Stay in your lane! Recent improvements to cyclists' safety laws make it much easier to share the road with vehicles that are many times bigger than you are ... be mindful that you don't drift or dart into traffic lanes, as that definitely weakens your case if you're struck.

Cyclist/vehicle accidents are showing a steady decline of about 6% annually in recent years, and that's a GOOD thing!

Remembering these safety tips can help you STAY SAFE OUT THERE!

It’s natural to assume that the two-way relationship you have with your employer will continue if you’ve been hurt on the job. After all, you know you’ve worked hard for them, and believe they have at least a certain level of care for your well-being.

Enter the employer’s workers comp insurance provider, though, and things change.

It’s now a three-way relationship, not a two-way one. And money is involved.

Think about how much "fun" that would be in a marriage!! At work, too, things can get dicey ...

Here are the top 5 ways injured employees inadvertently sabotage their own workers comp claims:

1) They fail to recognize the shift from a two-way relationship to a three-way transaction: Like it or not, comp claims are about money, and money involves transactions, not relationships.

2) They fail to get medical help right away: It’s easy (out of loyalty or monetary need) to assume certain types of injuries (especially repetitive stress injuries) will get better on their own, and keep working through the pain. This is ill advised, as it makes it much harder to prove that any injury that gets worse over time actually originated in the workplace.

3) They fail to get to witnesses before their employer does: Employers have much more power over other workers than fellow workers do, and can use that power to sway witnesses’ statements. Except where your injury incapacitates you, it’s best to ask other workers at the scene to provide you with statements of what they saw, in writing if possible, and forward them to your supervisor or HR department.

4) They minimize their injuries to coworkers: no one likes to be a complainer, but if you are experiencing pain as the result of a work-related task, it’s important NOT to minimize your pain so colleagues don’t worry about you. It’s OK to make vague statements of facts like “I’m not sure what’s going on here, but I …” and describe what you did and what you physically felt as a result of doing your task. Don’t say, “I’m sure I’ll be OK” as this absolutely weakens your claim!

5) They assume their employer has their best interests at heart: Sorry, but in their efforts to fill your spot as quickly as possible, employers typically seek to avoid the time, trouble, and expense of paying workers comp claims and look for ways to get you back to worker sooner than may be medically advisable. It’s easier than finding a replacement, even temporarily.
DON'T TAKE THAT BAIT; stick with what your doctor says. IT will almost always be used against you if you don't!
