This is a case which I recently handled in Palm Beach County. It underscores the difficulty in resolving a criminal case that everyone agreed was an accident . While we are pleased to resolve this case, we are still cognizant of the tragedy that happened.

Spent the last 11 days in a federal trial in WPB- jury came back this afternoon and acquitted my client on 7 of 8 counts. He was convicted of possessing ma*****na. He was looking at life if convicted as charged. Now he is looking at about a year on the ma*****na.

Christmas came early!

After litigating for 15 months in St Lucie County where my client was charged with a Fleeing to Elude;Resisting Arrest without violence and DUI.

I am happy to say that the state attorney Nolle Prossed the Fleeing To Elude and The resisting arrest without violence and he plead guilty to DUI just before jury selection

This case was about retribution for my client unleashing a verbal assault on a St Lucie County Deputy a week before his arrest. During the pendency of the case I filed a Motion to obtain personal cell phones of the 3 deputies to demonstrate their collusion and conspiracy to set my client up.

It's one of those cases that makes proud to be a criminal defense attorney!

2nd DUI Trial with in 5 years of a prior DUI -NOT GUILTY VERDICT RETURNED!

At the time my client was stopped on a residential street on Singer Island she was wearing her exercise shirt backwards and inside out. Additionally she was wearing a large Trump for President pin with DT's picture on it. Needless to say things quickly went down hill at the roadside investigation which resulted in her arrest for DUI. A logical explanation for all noted behaviors resulted in a just result.

Motion to Produce Personal Cell Phone Records of 3 St Lucie County Deputies granted today by Circuit Judge after 2.5 hour motion hearing.

My client verbally accosted a female deputy at the Jai Alai room in Ft. Pierce. 10 days later my client shows up again at the Jai Alai room and phone calls were exchange between the deputy who was working the detail at Jai Alai that night and the female deputy who was working Road Patrol that night. A third deputy was Contacted by phone and followed my client for more than 12 minutes down I- 95 without pulling him over. The Deputy then decided to pull my client over for speeding on the exit ramp - which has been proven to be unenforceable as the speed limit sign was black and yellow which is a suggested speed and not an enforceable speed.
The deputy put on his blue lights and my client drove 9 miles to his house at which time he was tackled to the ground and struck in the jaw with a palm strike. The Female deputy arrived on scene within 1 minute 30 seconds of the call and as she was helping my client off the ground greeted him with a "Hi Mike!"

Much work yet to do but today's ruling is what puts "gas" in our tanks as a criminal defense attorneys!
