SUBJECT: ENSURING ACCESS FOR ALL ARKANSANS AND VOTER PROTECTION ACT OF 2023
THE NAME IS IN ACCURATE IT DOES NEITHER. This new law makes it much harder for a Citizen or Citizens who want to amend a law or amend the Arkansas Constitution to do so. Before this law it was difficult out of 100 Amendment to the Arkansas Constitution only 18 amendments were achieved by an Initiative. Two recent Initiatives were medical ma*****na and legalizing casinos. An initiated amendment first must have the required signature, correct ballot title, and a lot of existing hurdles for the people to vote for or against the law or amendment. The latest initiate act that was on the 2020 was defeated which dealt with recreational use of ma*****na. We are the government. We don’t work for the legislators or governor. The people we elect are supposed to serve and protect our lives, liberty and property. The Initiative and Referendum both are guaranteed by Art. 5 §1 of our Constitution which is very detailed in the process and Constitution states the people only need 15 Counties to have petitions signed by 8% of the electors to amend statutory law and 10% of the electors to amend the Constitution.
The Legislator passed and the Governor signed HB 1419 which is now ACT 236 which amends the current law. NOW TO INITIATE A LAW OR CONSTITUTIONAL AMENDMENT REQUIRES PETITIONS FROM 50 COUNTIES (formerly 15) OUT OF 75 COUNTIES TO TAKE A PROPOSED LAW TO THE VOTERS (YOU AND I) AND EACH PETIION MUST BE SIGNED BY AT LEAST 50% OF THE ELECTORS (formerly 8% or 10%) FROM EACH OF THE 50 COUNTIES. The Legislatures did not amend their procedure to put an Amendment or Amendments on the ballot. Only a majority of the House and Senate is needed to propose an Amendment of the Constitution.
WE THE CITIZENS OF ARKANSAS are left without a viable right to propose legislation or constitution amendments. Why did the legislature pass such a law to make it harder for the citizens to submit a law or amendment to be voted on by the People? Please read the new law which can be found on the LEGILATURE’S WEB SITE OR BETTER YET ASK FOR A COPY FORM YOUR REPRESENTATIVE or SENATOR and ask how he or she voted. The new law is not long and applies to both the Initiative and Referendum.
I hope you and I will call our Representative and Senator and ask if he or she voted for such a law that makes it so much harder to propose a law or amendment? The fact that the requirements for an Initiative or Referendum are placed on the ballot it still must be voted on by We The People who must approve or deny the law or amendment. I asked my representatives Tosh and Ladyman and senator Sullivan if they had voted for the law and Senator Sullivan was the only legislator to respond and he said he did. I respect him for his response. I do believe that are legislators State and Federal forget they work for WE THE PEOPLE.
