If any of our school district clients have questions about this decision and a district's ability to regulate a student's off-campus speech, please give us a call.

In response to the U.S. Supreme Court's Mahanoy Area School District v. B.L. decision, NSBA commends the Court for making clear that it is not a question of how or where speech is made—whether on school grounds or online—but its impact or effect.

The justices were divided on whether to issue a sweeping ruling bringing First Amendment law for schools into the social media age or settle for a more modest decision.

The following message was sent out from the Arkansas Administrative Office Of The Courts this morning concerning Visitation issues COVID-19:

Visitation issues COVID-19

It has come to our attention that some parents are using COVID-19 as an excuse to withhold their children and prevent the other parent from exercising visitation. We want to emphasize that the Supreme Court’s Per Curiams regarding COVID-19 have not interfered with any child custody visitation orders. Absent certain circumstances, courts should be enforcing current visitation schedules to protect both parents’ access to the children. Participating in daily virtual learning and continuing with their regular visitation schedule provides children some normalcy in a time of uncertainty. We would encourage you to inform local attorneys that you are amenable to holding telephone or Zoom hearings to address time-sensitive visitation issues (e.g. Easter holiday visitation).

**** This means visitation orders are to stay in effect.
