A roundtable of retired immigration judges recently filed an amicus brief in support of our Petition for Rehearing/ Rehearing En Banc before the 1st Circuit. The group explains that an immigration judge has a statutory duty to develop the record during removal proceedings, particularly in asylum cases. Law360 wrote a brief article about our case (Varela Chavarria v. Garland) identifying some points made by the roundtable in support of our petition.
Dozens of former immigration judges pressed the First Circuit to grant a second shot at asylum for a Salvadoran woman fearing gang violence, saying an immigration judge had erred by not asking her if she belonged to an asylum-eligible community.
