“It’s October. Do you know who has the kids on Thanksgiving?”

If you hesitated, you’re not alone. Every year, parents in Duval, Clay, St. Johns, and Nassau counties wait until the week before the holidays to figure it out. By then, the texts have already turned into arguments.

Here’s what most people don’t realize:

If you have a court-ordered parenting plan, the holiday schedule in it isn’t a suggestion. It’s an order. Your ex can’t change it on their own, and neither can you. Skipping a handoff “just this once” can come back on you later.

If you don’t have a parenting plan yet, or yours is vague about holidays, you’re gambling with the most emotional days of the year. “We’ll figure it out” works until the first time you don’t agree.

A solid holiday schedule spells out:
✔ Who has Thanksgiving, Christmas Eve and Day, and winter break, and how it rotates year to year
✔ Exact pickup and drop-off times and locations
✔ What happens with birthdays, Mother’s and Father’s Day, and school breaks
✔ What to do if a parent travels

Sorting this out in October is much easier than in a panic on December 20th.

You’d be surprised how many people feel exactly this way.

You don’t have to be ready to file for divorce to speak with a Jacksonville family law attorney. Sometimes, getting answers before things reach a breaking point can help you make better decisions about your children, finances, property, and future.

“We weren’t married for 10 years, so I get nothing from his military pension.”

I hear this from military spouses in Jacksonville and Northeast Florida more often than you might think.

And that assumption could cost you.

If you’re going through a military divorce in Florida, don’t assume that being married for less than 10 years means you automatically walk away with nothing from your spouse’s military retirement.

Here’s where the confusion comes in:

The 10/10 rule does not determine whether a former spouse may be entitled to a share of military retired pay.

It generally determines whether that share can be paid directly by DFAS under the federal requirements.

That distinction matters.

And there are two other military divorce misconceptions I see:

🔹 “My spouse is active duty, so they can stop the divorce.”
Not necessarily. The Servicemembers Civil Relief Act (SCRA) can provide protections, including a potential stay when military duties materially affect the service member’s ability to participate, but it does not give someone a permanent way out of a Florida divorce.

🔹 “Deployment automatically changes our custody arrangement.”
Deployment can create temporary parenting challenges, but Florida law provides specific protections for military parents. Under Florida Statute §61.13002, a military parent’s deployment or mobilization does not automatically mean a permanent change to the parenting plan.

If you’re a military spouse in Jacksonville, Orange Park, Fleming Island, Green Cove Springs, St. Augustine, Ponte Vedra, Yulee, or Fernandina Beach, understanding your rights before signing a settlement can make a significant difference.

The most expensive mistake may be assuming you’re entitled to nothing before you know what the law actually provides.

"You'll get alimony for the rest of his life."

I still hear this in my office — from people who haven't looked at Florida law since it changed.

Permanent alimony is gone. As of 2023, Florida courts no longer award it. If you're facing a divorce in Jacksonville, Orange Park, St. Augustine, or Fernandina Beach right now, that changes how you need to plan — whether you're the one who might receive support, or the one who might pay it.

Here's what's left under Florida law:
🔹 Bridge-the-gap — capped at 2 years
🔹 Rehabilitative — up to 5 years, tied to a specific plan
🔹 Durational — capped based on how long you were married
🔹 Temporary — while the case is pending

For marriages under 10 years, durational alimony can't exceed half the length of the marriage. For 10–20-year marriages, it's capped at 60%. And under 3 years married? Durational alimony generally isn't on the table at all.

Walking into a divorce without knowing these numbers is walking in blind — on either side of it.

"If I can prove he cheated, I get everything, right?"

I hear a version of this question constantly. And I understand exactly why people believe it — it feels like it should be true.

Here's the real answer, and it's more nuanced than yes or no:

Florida is a no-fault state. You don't have to prove your spouse did anything wrong to get divorced — "the marriage is irretrievably broken" is enough. So no, cheating by itself doesn't hand you the house, the savings, or a bigger settlement.

But — and this is the part most people never hear — adultery isn't legally invisible either.

If marital money was spent on the affair — hotel rooms, gifts, rent for someone else, trips — a judge can factor that in. Not as punishment for cheating. As compensation for money that shouldn't have left the marriage in the first place.

That's the actual standard: not "did they cheat," but "did it cost the marriage money."

Same logic applies to custody — an affair alone rarely moves the needle. What matters is whether it affected the kids in a documented, concrete way.

Knowing which one your situation actually is — emotional or financial — changes everything about how your case should be built.

Not the résumé version. Not simply a number on a law firm website.

The real version.

For more than two decades, I’ve worked inside Florida’s legal system—as a Florida Assistant State Attorney, an attorney with the Florida Attorney General’s Ethics Bureau, a Guardian ad Litem Program state expert, and a family law attorney representing families throughout Northeast Florida.

And every chapter taught me something different.
