NACIMIENTO POR CIUDADANÍA EN ESTADOS UNIDOS: DECISIÓN DE LA CORTE SUPREMA

La Corte Suprema no determinó con este fallo, la constitucionalidad de la orden presidencial. El fallo permitió que la orden ejecutiva entrara en vigor en partes del país donde los tribunales inferiores no habían emitido órdenes judiciales. En otras palabras, en aquellos estados que no hubo una orden federal, la orden está en efecto. Para ser más claro, en estos estados, el nacimiento de un niño en los estados unidos de padres extranjeros, el niño no obtiene la ciudadanía estadounidense automáticamente.

Es probable que la decisión genere nuevas impugnaciones legales contra la orden de ciudadanía por nacimiento, posiblemente mediante demandas colectivas u otros medios.

Importante añadir, el fallo no modifica el derecho constitucional a la ciudadanía por nacimiento, tal como se establece en la Decimocuarta Enmienda. Esto contradice el fallo que le da el poder a ciertos estados en hacer cumplir la orden presidencial.

En resumen, la decisión de la Corte Suprema de hoy permite a la administración comenzar a implementar la orden de ciudadanía por nacimiento en algunas zonas, mientras continúan las batallas legales en otras. El fallo de la corte también señala un cambio en la forma en que los tribunales federales pueden bloquear las acciones presidenciales, lo que podría conducir a un panorama legal más dividido.
