So I was at the Chancery Court the other day during one of DHS' periodic child support enforcement hearings, and it reminded me of a few points regarding child support that any single parent should be aware of:

1. Child support is a duty owed to the child, not a right that belongs to the custodial parent.

2. Once entered by the court, a property settlement agreement including a child support provision is enforceable as an order of the court. Each missed payment is a separate violation of that court order and may be treated as contempt of court.

3. If for whatever reason, you can't afford your child support payments, the solution is not to stop paying them. All that will accomplish is to get summoned to court, and be ordered not only to make the original payments, but also be on the hook for interest and attorneys' fees. And face possible incarceration for contempt. The solution is to petition the court for a modification of the existing child support obligation and bring adequate proof to the court of the reduction in income and why this was unforeseeable at the time of entry of the original order.

The older I get, the more aware I become of the importance of having a valid will that records my intentions. The consequences of not having a properly executed and recorded testamentary instrument (a will, in non-legalese) can be dire.
