Breaking news! The Supreme Court just granted cert in a case about the religious exemptions to vaccines (Miller v. McDonald) and immediately overturned the second circuit's dismissal of these claims. Second Circuit now is directed to issue a new decision in light of precedent that they really can't get around. It's game over. We're getting the religious exemption back! Thank you Aaron Siri and all the people who have been working tirelessly on this for so long.

Today, we filed a petition for certiorari to the United States Supreme Court in Kane v. de Blasio today (now Kane v. City of New York). NYC adopted an openly discriminatory written religious accommodation policy that allowed Christian Scientists to be accommodated, but categorically excluded Catholics, Jews and most others. This case impacts thousands of City workers and the security of our most basic constitutional protections.

Breaking news in DiCapua v. NYC: in a watershed decision, Judge Porzio reinstated 10 NYC teachers with back pay, full seniority and benefits and awarded attorneys fees after finding their denials of religious accommodation “arbitrary and capricious.” But, he denied class certification. We are making a motion to reconsider that and some other points, but still celebrating this important win!

Update on DiCapua v. City of New York (NYC Teacher's religious discrimination case related to C-19 V): prayer vigil at 2:30pm before court on September 6, 2023 in the Richmond County Supreme Court (Staten Island). At 3:30, the Judge will let us know whether he the Court will certify a class and the decision on the Article 78 relief seeking reinstatement, back pay and other damages. Come if you can!

Big news in DiCapua v. City of New York. The Court denied New York City's motion to dismiss in its entirety. The NYC public school teachers' religious discrimination claims are all going forward. Motion for class action certification will be argued on August 14, 2023 at 11:30 am. Rally starts at 10:30 am outside the Richmond County Supreme Court (Staten Island). Peaceful presence welcome and encouraged. Dress up, says the Judge. Hope to see you there.

On July 18, we are scheduled for oral arguments in the Richmond County Supreme Court in the NYC DOE religious exemption discrimination case DiCapua v. City of New York (state law offshoot of Kane v. de Blasio). This is a big appearance. The Judge will be deciding whether to certify a class action of religious employees denied reasonable accommodation from the Covid-Vaccine mandate. Public and potential class members welcome to attend. People are gathering beforehand outside of the courthouse at 11am. Please be respectful and quiet in and out of court so that the Judge can focus on our arguments.
